Private road issues

We get similar type problems around here at times with boy racers using common land to drive on. I normally just get the car registration and report it to the police on 101 number. the police can issue a section 59 notice which is basically a ASBO for driving in an agressive way or in a way to cause distress to others. If they re offend the police can seize and crush the car. Seems to work for us and the police generally respond to reports of these cars, but it does help if you are on the local commoners committee as no action can result in a pointed letter to the police commissioner.

Put your complaint in writing to your Chief Constable outlining the fact that you have already reported the crime (reckless driving is a criminal offence as is antisocial behaviour and it seems this chap is guilty of both). Tell him that you know who the culprit is, that you are also trying to prevent any future accidents or even fatalities occurring and there is a real possibility of both happening and that to the best of your belief your crime report has not been investigated nor has the driver of the car been spoken to. Furthermore you are informing your insurance company of this letter so that they are aware that you have put your police force on Notice should legal proceedings need to be taken.

Couldn't your local NFU team do you a supporting letter to send to your police officers concerning this individual ? They are there to help their members after all and generally their input is very helpful in such matters.

As much as it pains me to admit it ... this sometimes does work :sneaky: Depends if you are in an area where a barn-burning might occur after such an encounter though :unsure:

Just wondering if anyone can give me any advice. We are having issues with a local sports car enthusiast using the roads around our farm. There is a public road runs through the valley and he has been asked several times to slow down while using it due to the livestock etc but has yet to listen and can be very rude! After a run in with him last week after him almost causing an accident while we were gathering he has now taken to using our farm road as one of his race tracks, So much so I cannot safely walk my dogs on it anymore if he is around, I have reported him but police say they have to catch him but they take so long to turn up he could be in France the way he drives!! Just wondering if anyone has any advice on how to deal with it? Is there anything the police can do that they are just refusing to offer? I've never been close enough to get a video of him on my phone that proves it is definitely him. What concerns me is he will need to cause an accident before they take us seriously.

Is the "farm road" part of the public road you mention or is it private road owned by you with no public right of way with a motor vehicle?
 
Way I see it, if its your private road, then he's there at his own risk, but, if he was killed by the dump trailer you left on a bend to trap him it could, not saying it would, but it could land you in some sort of bother. However, if the obstacle you leave out happens to be, oh I dunno, a trailer that's had a "puncture" and was left there, or some stones that have fallen off a trailer, then you will be 100% in the clear IMO. A few football sized rocks left in the centre of the track on a bend etc is all you need, it will take the Sump off his car and some. He would then be liable for the subsequent oil spill you can charge him for.
