We have to get out

Sometime ago I said here that me and my. brother had notice to quit from the landlord after our neighbour reported us to the landlord for being under stocked and not keeping fences in order and... last week the case went to court and we now have 42 days to get out... something that will be very difficult to do... there was a lady present from housing charity and lawyer representing landlord present at hearing and afterwards she told me that me and my brother can be forcibly removed and just turned out onto the road by bailiffs..

Are you in any farming unions that could help .
What is / was your legal representative responce .
Under stocking and poor fences sounds minor reasons to kick someone out?
This neighbour , are they after it ?

The neighbour now has what was our 30 bottom acres and someone from about 20 miles away has the rest we are not in any union...we have been here since 1962 .. I was 3 and just about remember ,we were on the old rent agreement which I think has a lot to do with it the neighbour who is a bigheadef little sh?t is paying a lot more rent

Always a shock to lose your home but if you paid rent and were under-stocked then were you making any money or are there other opportunities now?
 
I should add that the property is owned by the local council and the person in charge is completely useless and the only reason he got the job his father is a big chief at the council and he insists on been called Colonel... we were making very little profit

It might not seem like it now but you may eventually come to view this as a blessing, always plenty of farm jobs around and you could probably earn more and stress less as an employee... but there must be more to this story, a lot more. Did you attend the court proceeding? I thought it was near impossible to evict a farm tenant, especially if they are not in rent arrears! Neglecting maintenance could give some grounds for eviction but you must surely be given fair warning and reasonable time to make good, not just a see you in court letter? How can understocking even come into consideration, that is simply rectified by a few hours topping!! Anyone who is fully stocked this time of year would be seriously overstocked in the winter! You surely have a right of appeal? the original ruling to leave within 42 days seems highly unreasonable unless the only stock you have are 2 lambs and a chicken.
 
The council went by the book and we had more than 2 sheep and a chicken I went to the court and I talked to the council lawyer before ...why he told me that he was sacked from a previous job I do not know yes perhaps it is a blessing in disguise that we are finishing farming with so much uncertainty because of brexit but it will be difficult to change from a way of life we have lived for so many years... perhaps in a years time I will think different when things are sorted and I have visited my cousin in Canada

Did you not have any legal advice or representation? On what grounds are you being evicted? There's a lot more to this than has been posted in here.

Do you mind losing the farm? A bad way to go but would it remove a weight from your shoulders?

Will the council give you a house?
Dont leave till they do , at the very least.
What about the tfa?
If someone else has the land, they dont need the house, just tough it out.
 
We (me and my brother) are still here
And 2twice the local police community officer has been here with different person each time and very helpful lady from charity as well and she said that we might be ok for a bit longer ,l told her that we have lived here since 1962 and to be evicted is. Not good... I have also been to doctor and he is going to write letter to relevant person..but I told him under no circumstances whatsoever do I want any 'make you happy pills'
 
Deepest sympathy to @startinghandle, and I hope that he and his brother make full use of the various charities and trade associations available. They can be very useful.
However, I am under the impression that Council farm tenancies are legislated differently to AHA tenancies. (even if they are before 1976 etc).
You should have joined the TFA.
