This is true . The farmhouse we live in isn’t ours, but we’ve invested a lot in it to make it our home for the past 26years. ( tenants improvements)The children were born and brought up here.
On the flip side, we own another house that we’ve never lived in . An investment , not our home.
 
So Fred inherits the farm tells his sibling to fudge off maybe £10,000 each. The farm is worth 5 million quid.

He then gets planning and sells a small area 20 acre for 20 million.

Sibling all in rented houses asks if they can have a few quid. Fred tells them to fudge off.

Freds wife divorces him & gets a toy boy & gets 25% of the money.

Is that what Fred's parents wanted?

But Fred's farm is only worth £800,000 and a quarter of that is the concrete and sheds he has invested in over the 20 years

There are ways around the conundrum but it would rely on all parties talking well in advance of key points in passing on assets and for all to remain on talking terms. It is a very difficult area and many businesses will not stand sharing or dividing of assets. No reason why future major uplifts cannot be shared out with the wider family. Most probably not in that situation.

that is just the point I was trying to get across every situation is different and broad brush statements on TFF looking in from the outside are useless in fact worse than that

I thought 'Fred' was made up too.
The character I was referring to in my post is an actual farmer though. As you say all situations are different.

I'm afraid I've been pushed too far, and having spent fifteen years thinking I was paying off my mother's debts on my farm after things were split up between the my siblings, I've had a year now of effectively being kicked off the farm, as things were not put in place as I was told they were.

I know I've been very naive, but all I want to do is farm the farm, and the last two days have not been good. They know which buttons to push, and they're pushing hard.
I think I need to talk calmly, formally, and legally to someone about where to go from here.

If you have any, quietly put your guns in storage, before the accusations start.

Thanks, but I've spent enough years having to live in a caravan round the back of the buildings after my mother laid claim to the house I built, to have given up my licence a long time ago.

The trouble with that is that you start talking big money. And while I've been squirreling away a bit for the last year or so, knowing that eventually things would come to this, everything I've had before has gone straight into the farm.
I'm definitely on a kindly solicitor budget, not a barrister!

I fully understand where you are coming from but your solicitor however good is never going to beat their barrister.
Of course start off with a solicitor but you will need a barrister too.

you have my sympathy these family things are a pita I know I have the t-shirt, i can only wish you the best of luck
