Endurance wind power declare bankruptcy

I see local Worcs press have got hold of the news that Hartlebury has gone into administration. The administrators from Grant Thornton are restructuring specialists (one a very recently appointed partner) who have gone on record as stating that they want to realise the value in the 2 UK companies as a going concern.

If the 2 UK companies are sold as a going concern, then all the service contracts in place and warranties should remain valid surely?

That would be fine if you owned an X-series, but I think it's unlikely to happen.

The E-series warranty is from EWP Inc. The two companies mentioned in the article are Endurance Wind Power (UK) Ltd and Endurance Manufacturing (UK) Ltd, neither of which are obliged to honour E-series warranties..

I would agree Grant Thornton are specialists but I think you will find its in lining there own pockets.

Quite agree, and no one other than they and secured/preferential creditors will get a bean, just pointing out that the 2 named administrators are restricting/recovery/turnaround specialists within the GT Partners, rather than only insolvency/liquidation.
 
So if xyz renewables sell you an endurance turbine which goes wrong you have a claim against xyz renewables irrespective of whether endurance has gone bust of not - or did endurance sell all their turbines direct to the end user ??

We bought two Proven five years ago . When they went down we where left on our own . I just hope it all turns out better for you men than it has for us . Good luck .

That would depend on what was in your contract. But, the warranty is a "manufacturer's" warranty.

If you buy a BMW from a dealer, it's the manufacturer that backs the warranty, not the dealer.

Anyone purchasing any goods only has a claim against the supplier.
If the supplier goes bust, you have little or no claim.
Really helps Mosscliff supplied turbines:banghead: . Going need anti depressants shortly :(. Would have helped if my turbine produced the 168,000kws predicted but it's only doing 100,000kws which leaves major shortfalls financially.

I got a feeling alot of Endurance's dealers are stung very hard any how's

This may be so , but it is the dealer, in every case,who is legally responsible to the customer. This is the law in the UK.
If BMW went bust, the dealer would still be responsible for the warranty which went with the car.
The fact is that most car warranties are pan European , but you pay for it and I would expect at the end of the day are backed by an insurance policy.
Any longer term warranty should have insurance back up.

Hallmark have apparently now declared themselves insolvent and warrenty libility with the demise of endurance is apparehtly one the quoted reasons for it.
They may reform under another name having released themselves from any liability issues i suppose but there appers to be some more fall out yet to come the demise of Endurance
