What does working order mean?

I’ll ‘name and shame’ a dealer the other way round. I bought a ‘mature’ SP sprayer from Edwards & Farmer 3 years ago. I had been over it and listed a few things that needed sorting out before delivery, which were all done, and they rang to ask which set of (new, flat fan) nozzles I’d like supplied with it.?

Maybe I paid to much.....?

He’s got a nice berthoud racer 3200 in there now that I swapped in march

Afternoon, for the avoidance of doubt, we are the supplier of said sprayer. The customer was given the option of buying it “sold as seen without a test” or “tested and checked” and with a price difference of £350, the customer opted for “Sold as seen” cheaper price.

The sprayer had been winter prepared and had all the nozzles removed, spray-line joints disconnected and filter removed. These did not get put with the sprayer, and have been mislaid. Our Bad.

We have been organising replacements with our sprayer spares suppliers and yesterday forwarded the itemised quote from the supplier directly to the customer so that he could check quantities and part numbers so there was nothing missed. This has been misinterpreted as a request for the customer to pay for them. We had no intention of charging for them, as discussed with the customer on the phone today.

Although we sold the Sprayer “as seen without a test” and could technically wriggle out of this, we are helping the customer to get it complete, at our cost. We are currently waiting on a reply to our email from yesterday so we can get the required parts dispatched.

I trust this clears up and clarifies a few questions.

Well that almost cleared that up.

The OP states it was sold to him/her/them in ' working order ' and this has been the issue.

If sold in 'working order,' then of course it is worth the risk of saving £350.00 by not having further testing and checks, however if not sold in working order, then the risks are higher, however in this case, the words no warranty implied or given should also be part of the contract. The also ensures no come backs on you, or misunderstandings.

I cannot see how it could be sold "in working order" if still in its winter store state, because if not tried how would you know it came through the winter OK, and by tested do they mean, run some water through it, or a mot test.

I might be overly cynical but sending an invoice pricing the parts required without making it clear no payment was required sounds funny. After all the email had to be read approved and forwarded, a courtesy note attached would have saved further "misunderstanding" and embarrasment . Lessons to be learnt all round I think.

Well that looks like the end of that, however we are left to draw our own conclusions.

So, I assume the Sprayer was sold in Working Order, if not the OP may have been open to litigation.

The OP got his result by being supplied the required parts FOC, but not without adding his last comment.

These are only assumptions, and maybe be completely off the mark...............

What is has demonstrated, is the power of a public forum.

..........and if I really had a Chrystal Ball that worked, I'd guess at a Gem 24m trailed sprayer.
