Unfortunately I think that the insurance companies are too short sighted for that! Let's face it, the reason there's so many spurious motor insurance & personal injury claims is because they thought that paying off claims would be cheaper than discouraging them by fighting the cases!
Put it this way every man and dog will be in full support of the work done and except the packham brigade , the obvious point in defence here is none of the houses have flooded meaning many families not being rehoused during covid , I rest my defence.

I can’t understand for donkeys years ditches and rivers have been cleaned out
Why is it the ea now think it’s not needed most of the reasons they have for not dredging, there is plenty of reasons for dredging
Yep, if ever there was a time to clear the waterways you would think its now , with all the industrial estates collecting water and housing estates, but wildlife seems to be the priority for some reason .

How do they justify it on wildlife reasons
anything living on dry land gets drowned
Anything living in the river gets washed over the banks in floodwater to dye on land when the water recedes

I can see the EA dragging their heels taking JP to court, public opinion is appearing to be over 50% in support of the work done, even the dimmest of them must be able to see the merits of the job and many holding the purse strings will see the cost difference. The insurance industry will be in favour of reduced risks, the list is pretty long. The only thing the EA can bring a case with is their flawed principles.

I don't disagree that he's probably done a good job & it possibly was the right thing to do, but in law it will be argued that regardless of the result he should have applied for permission & undertaken various impact studies etc. All the EA need to do is prove that the work done required permission & that he did not have that permission in place, or other lawful authority to undertake the work - case closed. It will be argued that the improvement in flow will be at the expense of the environment in general & without the relevant studies having been done and approved by the EA, material harm has been done!

The EA will be very clever in their prosecution of the case as they do not want to risk losing the case as it will open the metaphorical flood gates for others to do as they like, which will lessen their power.
If there's a court case ,parish council meeting minutes say ea told him to get on with it, i think the ea are on a loser here

Because it’s an easier life driving about agreeing with popular opinion and telling people they can’t do stuff, compared to taking responsibility and making difficult choices contrary to what the local nimbys think.

Probably more likely for various flooded individuals taking the EA to court citing the work done on the Lugg as an example of how things should be done, either way it shows the EA in a very poor light.

And justifiably so. Listening to EA spokeswomen and spokesmen today on the telly talking about the flooding and how they were helping, I felt like chucking a brick at the box!!

Dave Throup(the EA guy who helped kick start this trial by social media with a tweet) was waxing lyrical on twitter today about how many thousand homes they are protecting during the current flooding.
Somebody posted the above photo of the lugg this morning, commenting on how well it was coping.
No response funnily enough
