Old tennant won’t leave

Good evening folks.
I have a problem on a tenancy we have just taken on and I don’t know how to go about getting the outcome needed. I’m hoping that someone will have some bullet proof answer which I can use to get me where we need to be.
The problem is that we took a farm on at the start of last month but the old tennant wasn’t to come out until the middle of that month snd we are paying the full rent for the farm while this old tenant gets full use of the farm. Now we thought to just pay the rent and he will leave quietly and we will get there in the end and nothing will be a problem. Moving on another month the old tenant is still on the premises and won’t leave and is making excuses after excuses. He was evicted from his last premises for not paying the rent and making a mess and a nuisance of him self to local residents and not he has done the same again and causing hassle all round.
He had about 20 calves which 5 have died of neglect over the last year and now he is using the excuse that he has no where to take these animals, which he was told to sell them and he was supposed to take them to market this last week but he hasn’t and now is saying that there is the odd ear tag missing which he could of had it sorted in the last 2 weeks so it’s just stringing it along.
My question, is there any resources or terms I can use to get him out to be able to carry on with our lives and hopefully he won’t be able to keep animals again as he isn’t fit to look after them feeding them every other day etc.

Landlords problem. He should be evicted. Stop paying the rent until your in, get a soliciter to put it in an escrow account.

My issue is that the landlord wants it easy which I can’t blame him etc as this is a sh!t show. The land agent isn’t putting any pressure on him either so they aren’t really pulling their weight. I think his holding number won’t be linked to the farm but I’m not sure. Is there any way I can see what his holding number is and then I can see what is recorded to the farm. He’s using animals as the excuse which is fairly good on his part but he’s had like a month so if he can’t sort something in this time he is obviously not doing any thing etc

Rupert Corduroy Brown needs to earn his agents fee. Stop paying the rent! That'll sharpen his mind. Send Rupert a letter by Registered post , copy to the LL.

Landlords issue,stop paying the rent and ask fir the rent already paid to be held over to start when you actually get full possession. Getting involved will only cost you money time and a bad reputation once it leaks out you’ve forced the previous tenant out on the street with animals to provide for and if they end up being destroyed because of tagging or passport issues animal welfare group will have you hanging from a tree.

Who is the BPS claimant?

The previous tenant I assume.

If the animals are not being looked after properly then get animal health involved,after all if you are the legal tenant then it is partially your responsibility to make sure welfare rules are not being broken.

It’s all a nightmare, I’ve got tackle outside which wants to come in, stuff what needs cleaning and no where to do it as we left the previous place before and stuck to our side of the bargain. We are now living out of friends yards with bits of stuff here and there while we wait patiently. It’s frustrating that people won’t stick to their side of the deal and he believes he is the victim which is the unbelievably thick icing on the cake. All his life he has tried pleading the victim but the key part of all his issues involve him!

The animals are that bad that he sent two to the market and they was 11 month old each and they made 70 quid each. We are the bps claimant as of the start of the last month but he just rents a few of the sheds but the landlord wanted us to have the whole farm to tidy it up and get this tennant out from not keeping his side of the deal. (Tidying, paying rent, etc)

As said, it's up to the Landlord to deal with.

Perhaps you were a bit naive paying the rent when the place was still occupied?

FWIW I think the Landlord and agent are right to play it cool. Any ructions and before you know it, the occupier is pointing a shotgun out the window and telling the media that the money grabbing farmer (you) wants to separate him from his beloved animals.

  • Don't stop paying your rent, its is grounds for closing your tenancy
  • This is the landlords problem and they are in breach of your agreement with them as it should have had vacant possession as a clause
  • Contact the TFA, they can assist you drafting a letter to your landlord/agent
  • Ultimately this probably isn't going to end peacefully or nicely so be up for a bit of a fight, don't lose your temper, do everything by the book and listen to professional advice
