Speak and write to someone senior before locking the gates to ensure they know the issues. With the potential for a serious accident then I think they will take action. My experience with some sub-contractors is that they will take every short--cut once the supervisor is out of sight so they need to have an obvious sanction. One company deducted £500 for any minor H&S breach such as taking a hi-vis jacket off to keep them on their toes
The above, also chain and lock the gate. Waste of time billing them as won’t get paid without a purchase order.
 
Get your agent to contact YW’s Estates department to set up a formal access agreement. State that until matters are resolved the gate will be locked. YW should pay your agent’s fees and agree to compensate you for the time that you have already spent resolving earlier issues.
Probably the agreement should state that they need to give you 24 hours notice to use the locked gate at an agreed time. A fee will need to be paid each time to cover your time spent in opening and securing the access gate.

A good way to wake them up/get a reaction is to (temporarily) block the access then obviously explain the reason you have had to do so.


Other practical things to do are make sure the gate (s) are very easy to open /close /swing/ latch/positively/ comfortably and put a modest sign there saying to close it behind them or else!
........ so they have no excuses.
Explain bluntly that the driver will be responsible if Cattle or people get maimed or killed.

Hit them hard and seriously. I'd have a chat with the wayleaves/ legal team and advise that you're inclined to withdraw access rights on the basis of failure to comply with health and safety law. Ask to see their risk assessments and advise they are not 'suitable and sufficient' as they don't include the importance of maintaining sterility of the livestock enclosure, etc. If you don't get a satisfactory answer, ask for a site meeting with both them and HSE present and remind them that they are jointly liable for any incidents on a shared workspace.

Decide in advance what you want from them, but I would expect them to either relocate the works elsewhere, pay for the roadway to be fenced off or something equally expensive. Might be worth having a figure in mind that would make you agree not to stock that field and only use it for cropping - ££££.

We got the same arrangement and easements but we put a padlock in a padlock.
They open theirs and we open ours when need .
Get water utilities boss mans phone number and issues.
If you got a land agent you use get him on the case too.

I had similar with Scottish Water a couple of times.
Got them to make up official Scottish Water signs with their logo on them saying Livestock in Field. Gates to be closed at all times. Have one on either side of gate.

Seems to have worked and your thick barsteward would maybe start swinging them than lifting them off if he had to close them again. Would still put top crook on upside down though just to be on the safe side.

Yorkshire water gain access to a sewage works through my land every 2 months they send a tanker to pump sewage and take it away for treatment. Twice now..... twice..... they have left the gate open and let my cattle out onto the road 25 cows and 25 calves and a bull, was the first time (June last year) when the driver actually lifted the gate of its crooks and laid it on the grass verge o_O,and just left it. Today it was only 4 cows and a couple of calves that made it out onto the road and a farming neighbour rang me and we got them back in.
I had a real go at them the first time but it seems like they have not learnt How would you take this forward? I do not want it to happen again.

My gut feel is put a cattle grid in. One less gate to have to open off a busy road would be a good thing in my view. You can still put a steel barrier gate across the track on the otherside of the grid to stop unauthorised access.
We are dealing with Limousin cattle here so I definatly want a gate ;) If cattle grid all and sundry would just drive in for picnics.

In post 5 you say they have access, what's the agreement say?
It looks like a well formed track, who owns it, maintains it, is it classed as a road etc?
For the third time, are you allowed a gate? If it's unrestricted access it might explain why they are not shutting it and why Yorkshire water don't have signs on it.
Not taking sides, it does sound like they are in the wrong but I think a bit more information would be handy, in case there's something you're not mentioning.

Will have to dig out the deeds, we bought the land 2000 and put up the corral to aid catching/ transporting cattle back to the steading . The sewage works have been there as long as I can remember .
never been a problem until last 2 years.
