AHA 2015 model clause

Just looking into a few issues we have , TA was drawn up many years ago , just came across the 2015 legislation , which is much more in a tenants favor than what we have . I presume the 2015 version doesn't replace what we have , is it just for use as a template for new agreement? And therefore wouldn't really have any relevance to us ?

Its a template for new agreements based on the old AHA style tenancy. It's the sort of thing you might negotiate if you were giving up some buildings or land as part of your AHA in exchange for investment in the farm or something.

My understanding is that the model clauses cover anything not covered by the original agreement. Thus if the agreement sets out a maintenance obligation then those are the terms regardless of the 2015 model clauses. But if there is something not specifically covered in your agreement then the model clauses apply. This is often relevant where a very old agreement doesnt mention things that didn't exist at the time e.g. modern type sewage plants, mains gas, electrical supply etc.

We've had some advice on this now , the model clauses are for items not specified in a tenancy agreement . If the 1973 model clauses are mentioned in your t.a these still apply. In all other cases the 2015 version is used .
