Am I right in thinking that when an aha tenant dies the tenancy ends & any partners in the farm business cannot carry on unless a new tenancy agreement Is reached.

Depends!

An Aha is an annual tenancy running from year to year, but has strict conditions including the fact it needs a notice to terminate.

Broadly if a tenancy is in an individual’s name and they die, the landlord can give 12 mts notice for the tenancy to end on a term date.

If in a partnership or company’s name things are different. Succession is a possibility subject to conditions.

AHA’s are heavily protected through statute and case law so there is never a straight answer without all the details.
