AHA TFA re rent review

When an agent tell you that so and so has paid x amount taking on a new farm in your area which is why you should pay more rent - don't take it ask true ask to see the evidence - i was stitched up like that !

I think most tenants have heard that little gem , it's irrelevant how much Billy Jones down the road is paying , rent should be decided on the earning capacity of YOUR farm .

I'm expecting the agent to be approaching us soon re rent review before brexit gets going if subs reduce they will want increase in place

I've always done it myself , but drop in the conversation that I'm a TFA member and I understand how rents on AHA tenancies should be arrived at, i.e.- earning capacity of the farm, not so much for house, cottage , buildings etc at commercial rates .
On our estate other farms are 6 months ahead of us, so what they agree tends to set the tone, although st the end of the day everyone argues that they've got less acres, worse land or older buildings than their neighbours.

If it is the case you are approached do what we did , buildings need x done , house needs y done , drainage needs replacing here and there.

Anyone on an aha needs to have someone look at the tenancy and have a definitive list on what you and the landlord are responsible for , you will be surprised as we were.

An aha tenancy is very well protected , don't fold and agree new terms without the proper help , a couple of thousand spent will be well worth it

I am awaiting an arbitration decision at the moment. Landlords agent wanted a 400% increase, luckily we have NFU arbitration insurance so we took advice and refused. it will have been going on for over two years come November!!, stupidly the landlord's agent just wouldn't negotiate at all and took it all the way....... all for 35 acres of marginal coastal steep grade 3-4!
We await the arbiters decision, eagerly.

A four fold increase sounds crazy but would not be bad if you was on £10 acre to start with
