I had a reply from the EA today to say carry on then for this year and get your house in order for next year.

So now I have a whole year to build a much larger concrete pad and associated tanks and juice distribution systems and to dig up all my heavy wet clay and replace it with something more amenable to spring muck application.

Don't replace your heavy clay with sand, otherwise you'll have P index 5's, then another headache.

And if there aren’t many RPS forms sent in then they will assume there is little issue. NFU will need constant "encouragement" to keep up the fight.
I think it is important, indeed I would urge everyone to tell the EA that they are using this RPS otherwise next spring they will shrug their shoulders and say it isn't affecting many farms so we can press on and ban outright autumn spreading beyond crop need. I sent my email this morning, if everyone informs them that they are using the RPS perhaps they will see sense?

Applying for an RPS will give them a heads up that you do the dastardly deed?!
If you inform them you are spreading under the RPS just make sure your application is planned, it doesn't exceed the 5Kg/Ha leaching limit and your P indices aren't too high to justify the application, also the application isn't going to cause any other type of pollution due to soil type, slope etc.
