It will be fine for this year. They cant ban it immediately that would be impractical and counter productive (although this whole thing is counter productive), so that makes it counter-counter productive, so maybe they will?

What's the punishment for breaking the rules? Lots will this year for certain
Currently probably BPS penalty. Potential if deemed deliberate could be complete loss! I doubt it would come to that this year but until the full announcement and the final details come out it really is anyone’s guess.

I’m not sure it would in effect be an immediate ban. Just enforcing rules that are already in place differently!

As said, it's not new, merely official interpretation of rules.

But sludge going to landfill - even the NFU couldn't fail to get some milage from that. Water companies would shrug, add the cost to the bill and say it was a "environmental disposal cost".

How can any one justify putting sludge to land fill, when we are supposed to be farming more sustainably? Let alone the environmental problems with leaching etc. A far better use would be to line up the rule makers and politicians and coat them liberally with it!
They can't seriously expect to dump it in landfill. But they would if they could get away with it. After all, happy to release into rivers.

Autumn applications or summer application for a winter cropping ? This is different terminology but it in some way its the same but also very different . Applying muck in October to plough down for winter now that is an autumn application .

Indeed ajd. But does the legislation and current EA guidance say that a cover crop has a requirement for Nitrogen. I am not interested in the common sense 'yes, of course' more the legal situation if an EA inspector doth a call. I am interested as FACTS qualified advisers (for what they are worth) may be soon enquiring of the indemnity insurers!?

Best wishes, J

On NFU webinar the man from EA said no

Can they stop you applying muck after hybrid rye ( harvested end June for AD), or even after winter barley , harvested in July . This would be summer not autumn application

Can you justify it for crop need? Simple answer is you can’t so yes they can stop you. Could be a lot of OSR going in. Maybe get the seed on one of those only pay if it grows deals?

Grow a lot of stubble turnips, so guess that’s a need. Otherwise it’s more maize in the spring

You are having a laugh. The Nfu have the worst media and marketing staff in the country. Whoever heads it up is entirely useless and should be ashamed of their whole career if this is the job they’ve aspired to. My dog has more idea about marketing.

As per usual the Nfu have done absolutely nothing to stop this, like they did nothing to stop Red Tractor ruining U.K. farming (oh wait that’s because they own red tractor) and why they did nothing to oppose the various trade agreements that will push U.K. agriculture down the toilet.

But what do you expect when the president is anti farming 🤷🏻‍♂️. She’s got a diversification that pays her £150k a year for being a ‘yes man’ president and aspiring to a MBE which is all the Nfu hierarchy want. They only care about themselves.
