BPS Entitlements Retained by Outgoing Tenant

Hello. I'm sure this has probably come up before but I cant find a definitive answer in the threads. I've already tried calling the RPA and thumbed through their online guidance and I don't have a land agent.

I qualify as a new entrant and young farmer.

Can I apply for BPS entitlements on a tenant farm if the outgoing tenant is retaining the entitlements or do I have to buy them off outgoing tenant?
I don't really want to fork out for BPS entitlements that could disappear next year (rumor and speculation)
Also I gather it would be best for me to apply as a young farmer (under 40) instead of new entrant, as I could apply for 25% top up payment available to young farmers?
If I have to look into buying BPS from outgoing tenant, how much would I be looking to pay, do I offer one years worth of payments calculated per ha? i.e. 100ha x £80 = £8,000 ?
Is their an approximate base rate for BPS entitlements depending on grade of land or pasture or arable or regional variation (SW vs SE) etc?

Any help much appreciated.

You can buy entitlements off whoever you like, as long as they are the right sort for your land. You don't have to buy from the outgoing tenant, but if they are for sale its the obvious first port of call as they'll be the exact amount you need.

If you are the new tenant then you can apply for whatever new entrant/young farmer entitlements are available based on the acreage of land you control. The BPS status of the old tenant is irrelevant.

You could rent them from him for a proportion of the amount receivable
Or buy/lease from somewhere else.

don’t forget they are discussing delinking entitlements from land so it may be best to get some now coz if they become delinked then there’s little incentive for the owner to sell them if they could claim the money without holding the land

I recently dealt with an incoming Crown Estates tenant and the outgoing tenant had to transfer his to the incomer with no money implication, presumably this was written into his tenancy. As said above you do not need to buy from outgoing tenant you can buy from anyone, £100/ha for England non-SDA was about right for 2020 but the deductions start from next year so they should cost slightly less. If you can sort a private deal you will save on agents fees, it is very straightforward to transfer entitlements online. My local agents will put buyers and sellers in touch with each other for no fee as long as they do their own paperwork and are regular clients of the firm.

Can I jump on this thread and ask can a new entrant/young farmer back date payments from the year entering if past the closing date for BPS submission?
