FSS with royalty paid to mobile seed dressing contractor.

Anyone know if we can claim the royalty back? What are the rules?

Some not planted. Some drilled and rotted off before it even emerged, so the plants haven't actually grown into anything that could produce a crop.
 
No you can't. They want you to pay for cover crops of your own farm saving so I don't think you have a chance. The royalty isn't huge per acre anyway

If you want to feel a sense of fair play then next time you drill FSS don't pay it and in that way instead of paying twice this year you will have paid once each year if helps you feel better. I wouldn't do it though but it is a compromise...

Just read that you can claim back the royalty if you didn't drill the seed in the autumn period.

Seems a bit harsh if we cannot claim it back when the seed wad planted but didn't grow.
 
my “seed” is just a extra clean heap of feed wheat until it get to a drill hopper

Once you get out of the bind of buying in dressed bought in seed its great! It has a psychological hold on you for a few years but clean grain straight out of the dryer from a clean field is easiest thing ever (with a bit of dressed parent/ grandparent seed now and again)

Thankyou @Clive for tagging the BSPB person. Guidanc on the law would be much appreciated.

Don't want to claim royalty back if not allowed to, but also don't really want to pay if not necessary.

Wonder if their is a Force Majeure clause.

Seems morally wrong to charge for seed intellectual propertys rights if the plant hasn't grown, as the farmer will not be benefiting in any way from the plant breeders genetics.

I'm 100% with Clive on this but i have just thought of a reason why the rules for declaring area with FFS might be different when it comes to bought in seed.

New wheat variety has Gravity type yield with Extase disease resistance score. Everybody wants at least a tonne to try but there are only 1000 available, and its all booked up immediatly after Cereals even though its a clear £100 more than any other option...

The seed breeder especially has every right to expect full payment up front for their work on this (particular batch of) seed. Whether it gets planted or not, rots or not.
