Building a log cabin for residential use on our own agricultural land - likely to get permission?

I thought curtilage was the garden attached to the farmhouse? Who would decide what comes under the curtilage of the farmhouse?


As an aside, how easy is it to adjust the curtilage?

For example, if the garden backs onto an odd shaped field corner and you wanted to adopt some of the field to increase the size of the garden and make the field a more helpful shape?

Obviously more complicated if there are subs incoming from the acreage of the farmed area.

Seems like you are asking an easy question however the answer is far from easy!

To extend the garden land is a simple change of use application, providing the change to a more domesticated use will not impact on a sensitive landscape or be detrimental to neighbours then there is very little reason for the council to refuse. HOWEVER, if you just seek change of use you are not seeking to enlarge the curtilage, garden land can be created outside of the curtilage and without expressly stating it in the application the council will not consider it within the curtilage and therefore it will not have any Permitted Development rights.

Also interesting to note, if you have been unlawfully using agricultural land for a period of 10 years and seek a lawful development certificate to make it lawful it does not become curtilage and does not inherit PD rights.
 
So I could apply for CoU to call part of the field amenity/leisure use, it would meet the existing garden but without altering the official curtilage boundary?
Correct, then you would be free to use it as an extension to your garden but you would not be permitted to errect structures, fences etc on it without permission.
