You must inform the owner, on the application form it says are you the owner and have been for the past 21 days. If not you must fill in a form and send it to the owner(s). If you do not know the owner then you must make an effort to notify them - this is generally done via a newspaper advert.
 
And do many of these applications proceed beyond planning without land owners consent and at what point is the owner informed im just flabbergasted it can happen
I doubt works can progress even if planning is granted. Also, the planning is granted to the land not the applicant so the legal owner could build what you had just got permission for.

We have just completed on a bit of land we did a deal on 18months ago, delay after delay, maps wrong, solicitors slow, not ours.
We have previously sold land and the buyers offer was conditional that it was completed in 30days. Not impossible, you need proactive solicitors on both sides, went to the wire though.

Thanks for those kind words addressed to the profession! Well actually we don’t mess aand delay things, if that is what you mean.You might be able to find a bad example of a solicitor but there are bad examples in every trade and profession. Don’t tar all with same brush…
Solicitors are the ringmasters and so tend to get the blame for everything. Before criticising just think about the complexity:
1. The vast majority of transactional work we do is fixed fee so there is no incentive to delay completion (the time we get paid) . But we still need to do the job correctly.
2. That fixed fee is a pre estimate of how long we think the job will take, so pointless work exploring every dead end and turning every stone at least once just means no margin left for us.
3. We don’t control the search providers but ours are fine.
4. We don’t draw the plans, especially on a sale of part and it is amazing how many plans are not Land Registry compliant. So we slow things down , you might say, in order to start off with a plan which will make it to the Land Registry.
5. For regular purchases with no further sale imminent the time from completion to registration is very very long. Nothing can be done by the solicitor for the purchaser in most cases. It takes time but it isn’t prejudicing you as the new owner. It annoys us as we have hundreds of files in limbo, finished….but not quite.
6. Mortgage lenders have their own agenda and do not always jump to their client’s tune.
7. For every party in a hurry there is one not in a hurry, maybe deliberately so. It may be to disguise fund raising problems, second thoughts, who knows?
8. Since covid everyone is very busy and making progress with most things seems to be harder than it used to be. Remember covid is still around and it does periodically slow production in a big way.
Other views are available but all I can suggest is that if the timescale is not what expect or you have a concern, have a word with your team.
And if you are a cash buyer, want no searches and have a huge appetite for risk, a transfer need not take long at all.

Thanks guys it’s much as I suspected, just wanted a bit of reassurance. Fingers crossed it will all sail through quickly. Other thing I’ve been thinking of is how do we stand regarding the bps as he has it on his for this year, can I buy it but he still keep control on paper to satisfy that box? As I don’t want to have to delay till next year if possible , cheers
Provision should be made in the contract for BPS and who has this year's payment.
It will be yours when your solicitor completes and pays the money irrespective of delay at LR.
Paying a pre- contract deposit does not ensure that the seller cannot back out. Contracts must be exchanged to prevent the seller backing out.
Searches can take a while in certain areas.
Conveyancing solicitors are overwhelmed at the moment due to the level of activity in the housing market and there is a shortage of conveyancing solicitors. The buy to let market is also very busy at the moment. Bounce back loans and sdlt holiday started it but you would expect a slowdown shortly.

Point taken, but when you're charging £475/hr and the chap in question was sent a questionnaire as to where he stores his rubbish bins, seems like someone is taking the pee somewhere.
The seller in question has spent the last year along with his agent/solicitor ensuring everything is all in order to facilitate a "quick" transaction.

Yep, I have had the questionnaire about whether or not I will be taking the toilet roll holder and also the question as to who will maintain the side of the hedges where the buyer would be the owner of the land on both sides of the hedge etc. I refused to fill any of it in.

The answer above was a £150 answer. :D

In our local city there’s a large Victorian terraced house area in the old grid iron pattern. Public highways and services as you would expect.
My then senior partner stormed in one day with a letter from a local opponent asking where the septic tank was!
Yes it does happen.😥
