Can someone claim BPS on land without owners knowledge?

I have recently inherited a parcel of land of 15 acres and have been trying to find out if the farmer currently renting it has been claiming single farm payment on it. He has rented it for the past 8 years. I have asked him and he says not but I am not sure if there is a way of finding this information out? Can he claim it without my knowledge. Any help would be much appreciated as I am totally new to Basic payment scheme etc.

Register yourself with RPA first;
Then ask them as the land owner.
If you dont have an account with your land on it, they wont talk to you.

And far far easier - get a land agent - best thing I ever did for dealing with the RPA - a good one is relentless and doesnt let the RPA forget they've just messed you about.

When you inherited the land did you inherit any entilments? Was the family member leaving it to you a farmer? Or was the land a speculative investment?

Thanks very much for that information, I will register with the RPA and will look into getting a land agent. My grandfather left it to me, he was a farmer but retired many years ago, he just kept it rented out so I am assuming it didn't have entitlements with it. Many thanks for your advice
 
Check that your grandfather didn't transfer the entitlements to the tenant on a loan / gift , because of the active farmer rules he may have agreed to return them back to the owner when finished.

Yes.

I've inherited a block of land, complete with it's very own tenant. He's bagged the SFP, wayleaves etc, etc.
Also rented some grassland out for silage cuts. Tenant claimed SFP on it that year. And for the next 3 years without my knowledge. Bless.:rolleyes:

its not really any of your business whether the tenant claimed sub or not.
He has the right to do so as a farmer, end of.
 
Do you not have grazing licences ? maybe he's not claiming because he's not eligible to claim in which case if I had just be left a field I would want to know so as maybe claim myself.

Its the general tone i object to.
As if it was illegal or something.
This system that passes subsidy to landlords really gets up my nose.
 
in most tenency agreement the is a clause that details that the tenant must maintain the claim status of land and inform the agent of the claim

pre sfp and entitlements the tenant claimed each year and owned the entitlements
since sfp new agreements often leased entiltlement with the land to be returned after the term
 
I dont think the poster said they intended to break the law and claim the subsidy, unless they are going to farm it, which we dont know?
The is intended for the active farmer by law, so if they are renting the land out, its a mute point as it wont increase the rent they can charge, and it wont go to them, BUT it would be fair for them to know if the subsidy is being claimed, as Naked acres, she could buy her own subsidy and include it in the tenancy as "leased entiltments" or sell them with the land when she sells up.

For such a small piece of land as well - it would look to me like just scouting for info prior to disposal, or letting under a proper tenancy.
