Cleaning out a ditch - implications for Cross Compliance

traul through the bps book on cross compliance and look at hedge cutting which is non between March1st and September 1st
it may be in the stewardship rules
but not sure cannot remember where I saw it
trouble is ignorance of the rule is not a sound defence

I have read the Cross Compliance Guide from start to finish. No mention of ditch clearing.

You will need to contact the environment agency to get a waste licence.I was told exemption D1 covered ditch spoil.There are also "Riparian owners legal obligations" to keep water flowing,probably aimed at streams and rivers,so depends on how much flows.As its a neighbour wanting to do it,I would get a legal letter from a land agent,making him responsible for getting all permissions ,dealing with the spoil and covering cross compliance.Its a ridiculous interference in our lives. had riparian obligations on a stream so needed to remove a few overhanging and fallen trees and branches,rang environment agency who said ok,but as it was in the banned hedge and tree cutting period ,I had to wait until september.Two agencys two different obligations.get a land agents letter and charge it to the neighbour!

Does CC insist on a green cover? I thought it was no cultivation, pesticide or fertiliser within 2m centre of a hedge or 1m from the top of the ditch bank, nothing to do with green cover. Could be wrong.

You must:
  • take all reasonable steps to maintain a green cover on land within 2 metres of the centre of a watercourse or field ditch, or to land from the edge of the watercourse or field ditch to 1 metre on the landward side of the top of the bank.

I still don;t really understand how you can sculp the banks though unless in that case its not a reasonable step and your allowed to do it
