Beware of so called "cropping licences." Unless you do all cultivations, planting, spraying etc you don't have the field at your disposal for BPS purposes. I suggest a contract & option agreement with the potato grower. They charge you for operations inputs. You sell them the crop later for the bills plus your "rent."

I don't have a contract I can PM as it would leave me liable. Ask your agent for a CAAV contract & option template.

This is one of the confusing things in the new system. How can the farmer claim to be active farmer and claim subsidy when potato grower does all the work and takes the risk? Not having a go but only saying it's one of the anomalies of the new regime. Think it may be worth spending money to get a proper lease in place to cover yourself.

As the spud man got it for 12 months is he cutting the hedges maintaining fences ditches etc

I think the new system is flawed too. But we will all have to make the right decisions to maximise it for own businesses - just like the guys did who happened to have sold a lot of cattle in the reference years for the old system. PS. I contacted a lawyer regarding the contract today.

I think your still an active farmer, even if you have the odd field growing potatoes, and it's part of a rotation .
Different if you let out the whole farm.

FT- my point is aimed more that it flies in the face of the definitions of active farmer and claimants. It's happening up here with seasonal grass lets. Problems could arise where tenant breaches cross compliance regs. Can all be sorted out by proper paperwork but again that costs money.

Donkey Oaty- like I said I wasn't having a go- those are the rules and you must play them as you see fit.

Good question. Probably the crop you intend to plant, but you had better check the application guidance for that.

15th May is the date at which you need that land at your disposal for the benefit of BPS or the Scottish equivalent.
