Digger Hire

My son hired a mini digger from someone local to us to level some hard-core. As he was finishing the track came off he and his sister put it back on but didn't do any more work with it. The machine was collected and about a week later my Son got a phone call telling him he damaged the track and was liable. The track wasn't new and my Son said why didn't they check it before collecting it. Nothing more was said but today while going through my fathers bank statements he found these people have taken the cost of a track I presume out of the account. Is this legal.

Poor lad I’ve had a few life lessons at that age it’s a sad day when you realise you cannot trust people. Perhaps arm yourself by asking for as much photographic evidence of their claim as they are willing to supply. May save the day if it does end up in court remember dealing with dumped vehicles we had to use a time stamped photo for legal purposes wether this applies or not to this would be interesting. Best of luck
