2. Notwithstanding paragraph 1, the acts and provisions listed in ANNEX LPFS-X shall not apply with respect to domestic support measures of the United Kingdom authoritieswithin the meaning of Part IV of the WTO Agreement on Agriculture up to a determined maximum overall annual level of support, and provided that a determined minimum percentage of that domestic support complies with the provisions of Annex2 to the WTO Agreement on Agriculture. The determination of the maximum exempted overall annual level of support and the minimum percentage shall be set by the Specialised Committee on the Level Playing Field and Sustainability and governed by the procedures set out in ArticleLPFS.2.3 [Procedures referred to in ArticleLPFS.2.1(2)]


Article LPFS.2.3: Procedures referred to in Article LPFS.2.1(2) [General provisions]

1. Within [six] months of the date of entryinto force of this Agreement, the Specialised Committee on the Level Playing Field and Sustainability shall determine the initial maximum exempted overall annual level of support and the initial minimum percentage referred to in Article LPFS.2.1(2) [General provisions], taking into account the most recent information available. The initial maximum exempted overall annual level of support shall be informed by the design of the United Kingdom's future agricultural support scheme as well as by the annual average of the total amount of domestic support incurred in the United Kingdom during the period of the current Multiannual Financial Framework 2014-2020. The initial minimum percentage shall be informed by the design of the United Kingdom's agricultural support scheme as well as by the percentage to which the overall domestic support in the Union complied with the provisions of Annex2 to the WTO Agreement on Agriculture as notified for the period concerned.

2. The Specialised Committee on the Level Playing Field and Sustainability shall adjust the level of support and percentage referred to in the first paragraph, informed by the design of the United Kingdom's agricultural support scheme, to any variation in the overall amount of domestic support in the Unionin each subsequent Multiannual Financial Framework.

3. If the Specialised Committee on the Level Playing Field and Sustainability fails to adjust the level of support and percentage in accordance with the second paragraph within one year of the date of entry into force of a new Multiannual Financial Framework, the application of ArticleLPFS.2.1(2) [General provisions] shall be suspended until the Specialised Committee on the Level Playing Field and Sustainability has adjusted the level of support and percentage.
 
So this looks to me as though this "Authority" has the right over override HMG policy if deemed unfit for the purposes of the "Level Playing Field". I think the words "Foxtrot Oscar" comes to mind.

Article LPFS.2.4: Relevant authority

1.The United Kingdom shall establish or maintain an operationally independent authority (“the relevant authority”). In performing its duties and exercising its powers, the relevant authority shall have the necessary guarantees of independence from political or other external influence and shall act impartially.

2.In respect of measures of the United Kingdom authorities that are subject to ArticleLPFS.2.1(1) [General provisions], the relevant authority shall have powers and functions equivalent to those of the European Commission acting under the acts and provisions listed in ANNEX LPFS-X. The relevant authority shall be appropriately equipped with the resources necessary for the full application and the effective enforcement, in accordance with ArticleLPFS.2.1(1) [General provisions], of the acts and provisions listed in ANNEX LPFS-X.

3.Decisions of the relevant authority shall produce in respect of and in the United Kingdom the same legal effects as those which comparable decisions of the European Commission acting under the acts and provisions listed in ANNEX LPFS-X produce within the Union and its Member States.

Well its nigh on five years since June 2016, and my it seems like yesterday. Five years soon goes. On an agricultural note BPS is being phased out from 2021 - 2027, so seven years, to allow adjustment time. Maybe it should go somewhat quicker.

I'm obviously pro-Brexit and glad to be rid of the EU, but a five year transition wouldn't bother me. Its a reasonable enough and, importantly, finite period for people who have been fishing here for decades to plan for what comes next, i.e. purchase of a fishing licence from HMG. It also provides time for a ecologically sustainable and commercially sustainable future fisheries policy to be developed. But then they may argue for another year, and another... I'd tell them they can have three years, then two on a reduced-fee licence, or forget it.

A 5 year transition period sounds pretty reasonable to me, if it gives full access to EU markets to sell that fish. Boris will be long gone by then, so no reason why there should be any extension.
It would give a reasonable time for the EU boats to increase their proportion of UK crew, license them over here, and arrange for boats to be waiting at UK ports so they can officially land their catches here for a few minutes.
