EA Exemption for bringing material onto farm

Hi All,

A client has asked me to look into the rules, regulations, exemptions etc involved in bringing subsoil / topsoil onto his farm from a non-agricultural origin to fill undulations in his land.

I know many of you will just say JFDI but he has some very up-tight neighbours and want's to ensure all the bases are covered.

I know the EA has licences and exemptions for all kinds of things, have any of you nice folk gone though this and can advise on the correct course of action.

Despite coming to me as his planning consultant it is not significant enough to require planning!

Yes, I looked online hoping it would be simple but it seems not. That link suggests that it is not possible to get an exception for what is effectively filling in a few hollows.
I did just what your client is looking at doing and to say the EA advice is confusing is an understatement.
I took advice from the NFU in the end and their take was that filling in a lake or quarry or valley etc is one thing but an hill or hollow is 'probably' ok.
I get the impression that the EA reserve the right to do you over . Full stop.

There are good and bad EA officers. First port of call would be to put your request in writing or as an email and ask for a visit. Make sure you give details of where the material is coming from and what you need it for in your email.

You might need a phone call or two to find the right person mind... ;-)

I'm interested in this also as I'm currently looking into filling a small valley in in a field.

as far as I know there is some sort of permitted development for land improvement?
as long as its under 2m deep and 465m2 but this may have increased on 1/April when the 465m2 changed for agg buildings.

mine is above this but I have 2 debates do a fare bit of it then claim another permitted development or just put 1 in and do the lot?
