Isn’t this already the case? If a farmer breaks Cross Compliance rules by spreading slurry on water logged soils, on river banks, etc, then he can be penalised with a reduction in area payments.

Plenty still seem to get away with doing it repeatedly though.

Not really sure I see the issue other than government bodies doing it. Aslong it’s proved absolutely that you’ve polluted intentionally or made no effort to manage it then you deserve a fine. Accidents do
Happen and that’s a different matter
