Escaped sheep killed by car on road

Asking for a friend, NOT! I stopped the tractor on the road waiting to turn right. I jumped off to open the gate, by the time I was back in the tractor there were cars coming so I couldn’t turn. The sheep started heading for the gate. I jumped off again to chase her back in but couldn’t cross the road infront of the oncoming cars. Sheep ran out and the first car hit her. Sheep was history and car has 3 panels damaged. What’s my liability? I opened the gate, effectively letting the sheep out. It’s in Scotland If that makes any difference. Thanks in advance.
 
Just asked wife who worked in insurance. Sorry,but you're responsible ☹️. If the sheep was on common land it's the driver's fault but because you lost the sheep onto the road it's on you. She doesn't think it's different in Scotland but you had better check

Sorry to hear about this. Sounds like it's a busy road, Could you make a 'sheeplock' ie build a pen from hurdles inside the gate so you can get the tractor in and the sheep can't get out? Once in you can shut your gate and open your hurdles at the same time. Same principle on the way out. Or would your hurdles just get knicked?
 
It happened to me me. Sheep on rented land gate left open by someone walking then a car hit the sheep. Driver went full on to police wanted top dollar for a car worth £150. I gave all of the information to the insurance and they sorted it for me.

What if the sheep had been a person? I wouldn't take legal advice from a forum. This is what you've got insurance for and if whilst passing you the driver did not have visibility of what might be coming out of the gate but still choose to pass you at speed then they also might be liable.
