Farmer payouts for missing advertised items at farm sales?!

Auctioneer told my wife today that as we have advertised a peice of kit in two local farm sales (obviously if it sells in one we will redraw it from the other) there may be disappointed buyer at their sale and that they have had to pay out upto 3k for mis leading people due to advertising a sale item that's not present in the past. Is there any truth in this, Iv been to sales where listed items aren't present, wouldn't even dream of expecting a payout from auctioneer?

Probably a bit of bull from the auctioneer, but by entering a lot into a sale you are agreeing to abide by their terms and conditions which may include a penalty clause for failure to make the item available for sale/selling elsewhere. When entering the item into a second sale, you should make it clear that the item is provisionally available subject to not selling in the first sale.

Think about it from their side & that of potential buyers - the buyers may well have travelled some distance in order to bid on one or two items that then don't arrive in the sale - in future that buyer will be more wary of going to sales by that auctioneer. The auctioneer is loosing not only his commission, but the confidence of potential buyers.

Plenty of store cattle don't turn up at Brecon auctions due to failing pre movement tests which can be disappointing for the vendor's regular buyers.
As said above - a load of tripe.

It'll be bollox....but I'd be very p!!ssed off if I'd travelled a couple of hours to potentially buy an item that you've sold previously

It should only be entered in one sale at a time, don't sell in the first then enter it in the second.

Prob in this case the auctioneer knows its pre booked in another sale thus why they have told the OP what they have.

Reminds me of the nonsense down here last year when one large arable farmer entered all his standing straw in two different sales with two different company's with both sales 4 days apart!

That is slightly different thou, nothing the vendors can do when it comes to failing PRMTs

we fully intend to tell auctineer if sold at other sale, they can clearly put it on website as withdrawn good weeks notice. i think they are disappointed as its a higher value item.

Only advertise if you are going to take a item to a sale, otherwise it's just wasting people's time. Not only the auctioneers but potential buyers who have travelled.

I doubt you'd enter the item in either sale, if a buyer saw it "advertised for sale" and come made an acceptable offer in the next day or two.
I wouldn't blame both auctioneers if they were to charge you an "advertisement fee" under such circumstances.

I seriously hope one auctioneer isn't Kivells as I had a wasted Saturday going to their collective sale at their Holsworthy site with intentions on buying machine that hadn't turned up but was advertised:(. Very disappointing
 
They all do it. Or let clients do it. We had the same fiasco trekking to sale down west for a portable welder which hadn't turned up. (L&T)
The auctioneer's comment was that we should have phoned before setting out and after they had ticketed stuff that was actually there.

I expect that in their small print is a get out for this side of the debate.

Trouble is it costs money for them to put it on the website/ local papers like the WMN on a Saturday.

Not really on tbh to book the same item into two sales at the same time!
