Everybody thinks they are covered for accidents, once the doo doo hits the big swirling thing you will find the responsibility for safety largely rests the the operator of the machine.

Machines also often come with handbooks, those handbooks have chapters covering safe operation, they also often explain that failure to apply checks to safe operation result in invalidated warranty and the manufacturer clear of any or all liabilities regarding damages or injuries to persons or property.
I'm well aware of that. I've seen the daily checks and torque settings for things like blade bolts but I don't know anyone who goes mowing with a torque wrench.
Was thinking more of an accident that was caused by the incorrect building of a machine, I'd rather not have that responsibility especially if I wasn't the operator.

Friend of mine collected his brand new Ferrari 348 (this is going back a bit) from the dealership in Pimperne. Didn't get far toward home before the brakes stopped working completely. Some choice words down the phone and Ferrari took the car back and refunded his money.
Crikey that’s going back a few years, must be 20 odd years since ferrari was in Pimperne?? story goes that someone pulled up there for petrol and Nigel Mansell himself came out and filled it up for them

Brand new diesel generator just waiting for first power cut. Sure enough the lines went down one winters evening. Fired it up and felt pretty smug with electric back on in house. Then darkness. Could hear it still running but no power. Went to have a look and crankshaft had snapped where it coupled to generator due to loose bolts where generator flanged to engine. Took months to get a new crankshaft. Finally got it going again. Not had a power cut since.

I know of dealers who are selling machinery still in the crate for customers to assemble themselves. A new, premium brand, 10ft trailed mower conditioner is £1000 cheaper if you build it yourself. Not sure what happens when it all goes wrong.
The regulations covering the supply of machinery state that the manufacturer is responsible for ensuring that the machine is safe to use. If the customer assembled the machine, the manufacturer has no control over whether the safety guards were fitted or not or if retaining clips/pins etc were in place. So they are on very shaky ground if they supply the machine in pieces. Even if they employ a student to assemble it, they are required to inspect it before despatch to ensure that the work was done correctly. Its also a legal requirement to provide an operators manual.

Oh yes!
I had a loader supplier on a new tractor, wanted the manual to check how to remove loader.
Asked dealer who asked manufacturer. Took until I contacted finance company and was going to withhold payment to get a manual 6 months after delivery!

Brand spanking new hedge trimmer, went to the yard, hitched it on, something wasn't right, spent 2 or 3 days in the dealers yard and had a whole new valve chest fitted. It was a yellow one, take your pick

2001 - I was 24, First new machine I purchased, spang new pottinger forage wagon. Picked up from dealers night before hand with my lovely 956xl. Set off in morning to go and pick up silage. T junction at foot of brae successfully manoeuvred but felt a funny clunk. Went to turn off road down to farm but tractor was behaving like diff lock was stuck on, then a clunk and all was well again. Parked up & did a 360 of my new pride & joy to find a bent up mangled drawbar & pto shaft. Lift arm had been half down & hadn’t noticed.???

A friend of mine picked up a brand new Merc Citan van from a hire company and promptly filled the diesel tank with Ad Blue they realised their mistake and a mechanic from the dealership came out and apparently sorted it out. Less than 30 miles later it conked out needing a new engine.

Demonstrator DB 1410 4WD first of the Q cabs, 4 hours on the clock, only borrowed it to get up some steep fields which we had on a short term let, part way up had to change down a gear, gear lever snapped off clean. Managed to change down to a lower range, but now it'll only do around 4mph, seemed to take forever to get back to the yard. Rang the factory to report the problem, the reply "oh bugger not another one". Supposed to be having it for a week, they took it away and never saw another one.

The inclusion of ‘Ooo Bugger’ as a preface definitely adds to the authenticity of that response.. :)

next doors new househam turned up with no nozzles, had to rob them of the trade in before he loaded it on the lorry, then spent the next 2 weeks under and over applying because no one had calibrated anything and to top it off the suction hose in the tank wasn't held down just luck if it sucked the tank dry . its ok now he says though ??

Over the years what are the worst breakages you have had on brand new machines within their first week or so of use.
I ask the above as main drive belt broke on the brand new combine at the small estate where my wife is secretary ,on the second day of use this season. Trouble was it cut through the main wiring harness when it disintegrated!!!!
I heard last year of a brand new combine catching on fire and burnt out as it was on the road going to cut its first field!!
I have not named makes of combine as they were not the same.
So just interested to know what maddening dramas you have had with brand new kit.
In 2018 we had the engine blow up on a brand new combine. Second day of harvest only 15 hours on the clock! Luckily our trade in was still in the yard (albeit a different colour and not winter serviced at all) so we got that out. They also sent us the demonstrator to run until ours was fixed. New engine had to come from Italy so took about 20 days before we got our one back. Can’t complain with the service we received in the end

So did your old trade in give any bother in that 20 days and who paid if it did?
