Actually you are wrong, when roads are closed for repair etc. This does not apply to walkers cyclists and I believe horse riders, who are still legally within their right to pass
as a cyclist it is very rare to find anyone actually doing anything
Very often doesn't apply to agricultural traffic. Have a look at the wording of the road closure document. It very often states that the road closure can not restrict the passage of agricultural vehicles.

"Nothing in the Order shall prevent driving upon the said lengths of road of any vehicle which is being used for the conveyance of persons goods or merchandise to or from any premises situate on or adjacent to the lengths of road or in connection with agriculture building construction works of repair and the like or use in an emergency of vehicles for fire brigade ambulance or police purposes."

There is a way to create a new right of way, it is called Express Dedication where a landowner offers the route and the users accept the route.

There are two disadvantages though, 1. the old route still exists, (not sure how easy it is for a extinguishing order) and
2. getting the local council, who are responsible for upkeep, to accept it and put it on the map.

This method has been widely used in the Mendip Area, mostly to create new multi user routes uprating footpaths and it has been "tested" several times legally. There was payment involved I understand. The organisation is called the Trails Trust.

Under the present system, getting a route moved is expensive and long winded and the Ramblers more or less object on principle. Riders are usually easier as they are just grateful for any route they can use. There was a bridlepath that I used that went straight past the front of a cottage. The last time I went the garden had been fenced and the bridlepath went around the outside of the garden, no problem for anyone using it - much better - and privacy for the cottage owner. Of course, if it is all on your land then it is easy, not so much if it is someone else's.

Making it easier to move rights of way is something that regularly comes up, really the whole legislation should be reviewed and renewed but it would be a massive undertaking and since Governments usually have other things on their mind and it isn't really a vote winner it keeps getting pushed further to the back of the queue.

Governments wont make moving or closing rights of way easy be cause the ramblers have several million voters who they will organise in an instant. They are currently lobbying hard to stop the formal shutting of the statutory maps delineating rights of way saying that the last 40 years has been insufficient to identify them all, in reality dreaming up new ones.

Why because I metal detect? I have to gain permission and there is no detecting during this epidemic as I respect that no farmer would want people on there fields right now. I wanted to give honest opinion from a non farmer that is all.

I wouldn’t worry about it. Hypocracy is quite a long word and it’s likely he doesn’t actually know what it means.
