Garden to field boundary

Hi

looking for both views(although I think I know what they will be) and advice from a more legal standpoint.

we have a field that adjoins a garden. The fence is their responsibility as shown by the deeds.

the fence was renewed with a new one that should have been stock proof. It consists of pig wire and rail at most 3 1/2 foot tall.

there were no shrubs planted along this fence line initially.

Now there are a lot of shrubs, some might be poisonous but am not sure.
Our stock can lean over fence to eat the plants which we have had some grief about (recently since asking them not to dump garden waste in our field.

questions are; is the fence stock proof if they can lean over it to gain access to the other side
What are the legalities of planting poisonous plants within easy reach of livestock?
Our farm is a duchy holding.
All views/answers appreciated

I stand to be corrected but I believe that their responsibility to fence ends with protecting your land from their stock( Dogs, kids etc) I dont think they are responsible to protect your stock from eating their plantings. The responsibility is yours to prevent your stock reaching over, to protect the plantings and avoid possible poisoning etc. A hot wire while field is grazed would be easy and good neighbourly. Regarding dumping, just chuck it back!

That sounds fair enough and I was of a similar view however, they are responsible for the fence and should have erected a stock proof one as they were told to do so (not by us the Duchy). As the stock can gain access to their property it would seem that it is not stock proof.
Regards them keeping their dogs in, they have cut a hole in the pig wire so the dogs can have free access to the field whenever they like. This raises a separate issue of neospora contamination.
it should be noted that they are of a farming background although their farm is being developed. She is an abhorrent women so neighbourly doesn’t come into it

Put a good fence up inside theirs plant a hawthorn hedge ,inbetween

Just put a hot wire up, if your stock damage their fence pushing over it you won’t have a leg to stand on. I would write to them about the dog access pointing out the possible disease problem and asking politely for them to please block it up.
In my experience trying to keep it on a low level by being polite is better than escalating it to point of being. nasty or getting legal.
 
People putting carp over the fence really gets my goat- tell them to stop and if it happens again you will bring a loader and tip the lot right back over. It's not legal to flytip waste on someone else's property.

How long is it? Heras fence it just for a laugh :LOL:cheap,when they moan about it say it’s that or can u live with them eating the odd plant.as for the waste etc tip it back over (my neighbours soon stopped when I tipped it back) as for the dogs buy 1sheep stick it in the field if you see it worrying it shoot it.might seem a bit savage but you can get some right knob heads as neighbours
