In 2012 we have a photo of a 8 foot gate that goes into a field, now the gate is long gone and a hedge in its place. Can I cut the hedge down now even though its nesting season and in stall two 8 foot gates making the opening to 16 foot without permission. its also next to my neighbour's property ?.

You mean the gate is long gone buried in the overgrown hedge

Trim the hedge back with hand shears or similar after visual inspection for nests.
Do a bit a week if you want.
Then people get used to seeing a gate.

Save old views from streetview etc.
