Getting paid for straw ?

what legal case ?

I’ve digested replies here and the. constructive replies some have offered will influence how i sell straw in the future if indeed i sell straw again at all

the thread had prompted a meeting tomorrow…….. one at which i hope a cheque book will be present !
Looks like the thread was a good call then dispute the criticism (y)

amazed frankly how many seem to think paying your bills 5 months late is in anyway acceptable
i certainly don't think it is acceptable. always paid bills on a monthly basis and got the same in return. if i was waiting 5mths for payment i would go and see the guy and not leave till i had the cash in my hand. but i'm retired so probably out of touch.

Probably a good idea to chop the lot as you'll never get a loaded straw lorry out of the drive next year!!

lesson learnt though - auction sales from now on or chopper on as its just not worth it
I don’t think that is a great idea, many auction buyers are those that cannot keep a relationship with a farmer year on year through not doing what they promised. Surely you have some up that way with a good reputation for baling it as soon as it if fit, then moving it promptly and paying when a request is made.

And why would he want someone coming on the farm with a baler who he may not know , could make hell of a mess
 
Can't understand why you would have a contractors baler on the farm?!? One of the major ways blackgrass is spread round here. We bale most straw with muck for straw agreements, but its our own baler and they collect the bales from the field.

A couple of hundred years ago, lots of smaller farmers got evicted as farms got bigger, and if they couldnt afford to emigrate, they became straw merchants or “ men of straw” which became a nickname for someone with almost no money eking out a precarious existence.
Nothing has changed.
this is true, its not a game i would want to be in.

I was meaning if he sold by Auction , he will have no control on who gets it
The most local straw auction too Clive also doesn’t really attract any buyers from Clive’s area, apart from the merchant in question… I might buy a few acres if he puts it in auction since it’s local too me 😅 then send the merchant in question too bale it for me 😂😂😂

I’m not sure what the legalities are these days for being able to enforce Credit Charges on an Invoice.
Many businesses used to apply them to invoices, which they claimed could be knocked off if the Gross amount was paid by a certain date.

It used to be the case they they were not legally enforceable unless the company presenting the invoice was a licensed Credit Broker, such as a firm that sells Fertiliser on a specific Buy now, Pay later scheme.
In such a case, even if such a scheme wasn’t used, the debtor had to pay the Credit Charges if he did not pay by the due date.
Many firms would include Credit Charges on an Invoice, who were not licensed Credit Brokers. However they could not be enforced.

Another way of doing it that was legally enforceable was to give a discount on an invoice, if it was paid by a certain date. If you paid after that date, the discount was lost. This was a good way of encouraging payments on time, because it got around the legality of Credit Charges, if the the Invoice sender was not a licensed Credit Broker.

Perhaps @Danllan could give his views on the current Credit Charge liability situation.
