H&S questions -- grandfather rights and machine testing

I thought I understood these points, but now am not so sure:

I understand that you have to have your telehandler checked every 12 months, or every 6 months if using a man basket. What about 360 tracked excavators?

For what activities do grandfather rights still exist? Reading through Farmwise from the HSE, it does appear that there are grandfather rights for chainsaw use if your employees are doing work on your own land and have used a chainsaw since before circa 1998. What about telehandler use, or do you need a training certificate? What about 360 excavator use? What about manual handling?

360 needs annual test under LOLER if you use it for lifting, otherwise only if your insurer wants it.

Anything used for commercial lifting (not the same as loading) falls undergo LOLER annual test. Anything used for lifting people needs 6 monthly test.

Thanks. Had just found the relevant LOLER bit for 360 diggers.

Any idea on whether seasoned employees need to go on a telehandler course?

Alright....what if you've got a mate;), with a telehandler;),who's self employed;) and just uses it to load grain and straw etc.;)
 
However, extract from the last link:

"Certificates of basic training: There is no legal requirement to issue certificates of basic training, but they provide evidence that operators have received relevant training and achieved an appropriate level of operating ability. The employee will need evidence of training if they change jobs. Note: There is no such thing as a lift-truck ‘licence’."

I think there is one standard for HSE and perhaps another for your insurer. We have the NFU risk people coming out in a few weeks so I will be able to ask all these questions then.

We have one guy who has a certificate. I'm not sure if he can provide basic training to the other guys? All have 30 plus years of experience.
 
If you're self employed anything goes , if you have employees it's a different game and rightly so.

Since I've had to get into my "by the book" mentality this evening, that isn't strictly true. On page 1 of the above HSE link on forklift training: "If you are self-employed, you need to do the same type of training, and achieve the same standard, as employers are required to provide to their employees."

Theoretically , but you are allowed to kill yourself
