Yes they are cakes. Headline legal case lost by HMRC in 1991 regarding VAT. After extensive court time, it was established by learned counsel that cakes go hard when stale,whereas biscuits go soft. Judges convinced, case settled, tax refunded, job done.

Ahhh, the 'succulent' Jaffa Cake

As this is a biscuit thread, I refrained from mentioning the ubiquitous J.C.
If you leave a biscuit in air, it goes soft - if you leave a cake in air it goes hard.
Therefore Jaffa Cakes are cakes........QED.
