I could really do with some advice

Hello

I rent a field which I use to keep horses on.

I needed a paddock either topping or bailing for hay. I saw a recommendation for a contractor on an equestrian Facebook page so sent a message. He rang and arranged to come have a look.

I have never had any involvement with field management before and I admit to being completely naive.

He came out on Sunday 18th June, said he was bailing quite a few fields in the area and could cut it the following day, otherwise he wouldn't be able to do it. He said it would be £500 and yield app 200 bales. Field is only just over an acre and a half. We agreed to this and asked for his bank details. He refused and said cash only as he doesn't tell hmrc about his work.

On Monday he came and cut the grass which was knee high. He said he would return daily to turn it. We paid him £250 in cash as that is the limit on my husbands card daily.

He never returned till the Wednesday when he turned it. He said he was hoping to bale it that day. I told him not to as it was wet. He wanted the rest of his money. The actual yield was 125 small bales.
He only turned it once.

When we got to the yard on Wednesday evening he had bailed the lot. He said some of it was a touch damp and to stack it in the barn to dry out. It was soaking. Thankfully we did not put it in the barn lest it would have gone up in flames. The following day, some bales were fiercely hot. By Friday they were all burning hot and thick with mould.

I sent him a text message stating how unhappy I was. He turned up unannounced that evening at the field. Even when showing him the mould and the readings on the thermometers, he was adamant that it was simply a case of spinning it and rebaleing it. The mould would not be an issue. The mould is toxic to horses yet he said he sells it all the time and it's fine. I told him I want my money back. And I want it in writing. He just gave me abuse.

No contact. I message him Sunday 23rd June. He again turns up at the field unannounced. Very aggressive and really obnoxious. When he arrived we were splitting bales to lessen the heat. I have videos and many pictures. Again he sees no problems with the potential fire hazard he's left me with or the mould or the fact that I now have no money, no hay and no grass. He decides he wants to take the hay, spin it, bale it and sell it on. This cannot happen. He will kill someone's horse if he sells this. And he's definitely not taking it without my money back.

This hay is still on my field which is chained and padlocked. It is literally a mound of mould.

I have asked and asked for him to sort this but he just ignored me. He has now contacted me via text saying I will be getting a solicitors letter and he knows where I live!!

He has many businesses with different addresses, all doing the same thing ie: baling, farm machinery etc and I assumed he was a proper contractor.

I am genuinely worried about the horses now as there's no houses near the field. Any ideas please?

No one else will buy the hay, if it's as bad as you say. Let him take the hay instead of paying another £250 ?
Chalk it down to experience, and don't use him again.
Probably better just topping your own field, and buying hay in...

He's refusing to take the hay, refusing to refund his only contact since Sunday is a text message saying I will be getting a solicitors letter and he knows where I live!!

Tell him to send the letter. Show it to hmrc. Social media is a good place to offer advice to others...make sure he knows this. He needs to return your money, in full, in cash, plus compensation. Have you any pics of him cutting turning or baling said hay? He also needs to remove the shite hay. What a twot.

Sadly, sometimes your first loss is your best loss.

Do not respond to his threats, I would if you have resisted in replying without direct response to them already, take your phone to the police and ask for them to be recorded, and you be given a reference number, just incase. The rest of your dealing is a civil matter, threats are not.

There is little else you can do, imo you would be throwing good money after bad to continue to deal with this person. Looks like you will have to buy your fodder elsewhere.

If the baleage is as bad as you say, burn it, or, if it will do for cattle get rid at say 50p per bale, and at least make a little of your cash back.

I have lots of pics and videos of the hay and the temperatures/ mould etc.
I also find it really worrying he thinks it's acceptable to sell hay like this to other horses
Due to his message saying he knows where I live, I have now contacted the police. I have an incident number and they are aware.
Nobody will buy hay with mould or that's been heated , you can't hide it , first bale that's cut open will tell a tale , so I wouldn't worry about that ,

Sounds awful, word of advice on such a small acreage, its not worth having done - 10ac is the minimum really worth cutting - small jobs often get rushed and this is the result.

If baling before dry due to weather, always get the wrapped, that said you were doing small bales so even less economical.

If you can dry the bales out, perhaps you can sell them as Biomass fuel at £1 a bale for people with boilers? Or as fit for bedding, sheep and cattle would pick through any they could eat in the bedding (Mine happily do) and the rest is heaped up with the muck.

Given your keeping horses, and their propensity to be picky, and your own personal tastes in hay type may be different from what someone else would see as fit to feed, its probabbly best to shop around and buy in after inspecting the hay yourself first, then you cant complain and also dont have to worry!

That's not always true, some contractors will take as much trouble with an acre as they would with ten, we are not all like this chap what he charged for what he done was extortion, it was bloody expensive even if he done the job right
don't tar all with the same brush

I didn't mean it like that! I meant it as in time constraints when the weather turns! most contractors have always been straight with me like that! economy of scale etc! And often when time crunches thenxhoixe between the 30ax block or the 2ac field with bad access and needing smaller equipt etc... I've had it happen to me.

That said I wants charged full whack and made haylege instead. eitger way this guy sounds a badger.

This prat has taken advantage of your inexperience.
Haymaking can go wrong. Make no mistake about that.
If the weather wasn't ideal mowing Monday and tedding Wednesday wasn't anything unusual. However to say he was going to bale it on the day of first tedding is odd. If the field only 1.5 acres then 125 is normal. Quite good if no fertiliser or other management. 200 would be quite excessive.
Price wise he is very expensive to say the least but perhaps there are reasons. Was he to cart and stack? This could bump up the price substantially.
As regards reporting him to hmrc. That may not be much use as he would probably just say he only takes cash for such jobs to keep payers in order. Plenty of legitimate reasons for only taking cash.
I'm not trying to defend him in the slightest but legal battles with him may cause you more trouble than its worth.
