yorkshire wildlife trust caught cutting hedges in the nesting season is this illegal?? It is for us farmers !!

Don’t know if they receive owt . Doubt it they have plenty of money to waste!! Bad job though they are the ones that do all the preaching!!

It's the disturbing of nesting birds that is illegal. Translated into cross compliance, it is mechanical (tractor) trimming finishes at 1 March. Manual cutting, hedge laying etc can continue to 1 April on the basis that you are more likely to spot nests than when on a tractor and should not disturb one when found. So no, they are not doing anything illegal, just as my neighbouring farming who is still hedgelaying is not doing anything illegal.

But if you destroy birds nests as part of that process, or cause nest abandonment, be prepared for a fine and a criminal record. A birding friend of mine is often called in as an expert witness for birds nest destruction (not just hedges, but people knocking martin and swallow nests down because they don't like the cr*p under them, etc).

:rolleyes: Just had to er, relocate four jackdaw nests to get to our gas bottles, two of the nests were using the valves as a base. I shall cite fire risk if plod comes round.;)
