Landlord/tenant rights arbitration

Hi all, just looking for some advice, we have a dispute with landlord over access rights, they are threatening to seek declarity relief from the court about their ability to rely upon reservations made within aha dated pre 86.

Does anyone know if this type of dispute falls with arbitration as I've read somewhere that if it does they have to go down this route?

How long can you make arbitration last without spending too much money?,

And finally, if they can go straight to declarity relief route first what's the general time scale for this process?

In our circumstances landlord can't afford any delay so the longer this dispute takes to resolve the better.

Yes you can. tfa.org.uk. Costs £75, lasts a year, you might need an agent but there a good starting point, if you call you get advice instantly and they recently started a members only forum where you can get advice from other tenants.

Thanks for everyone's views. I didn't join TFA in November because someone said you had to wait a year to access services. I have just joined this afternoon and can confirm personally you have instant access and advice. I also contacted a solicitor but was trying to keep costs down in these early stages. I fully accept that they will be required in the long term just wanted some initial questions answered to make sure we are going down the right path.

Its where a court determines the actual meaning and extent of something IE in this case whether or not the right to inspection also extends to the right to survey the land for development, or whether that would require a separate element in the contract to be created to the effect of "right to access to survey the land"
