A genuine " shove your job up your arse " moment eh ?? Good on you any spudman who doesent know when he has good help deserves a wake up call .
Its not like experienced help is forming a queue at the gate nowadays is it .
Ide had a gut full of sonny jims attitude right through harvest ,,allways finding something more important to do when the drier needed cleaning out from feed to seed or barley to wheat,,or the bins needed shoveling out ,,then one day he stood watching me changing the plough points ,,He piped up ,,I think when you go back you should ,he didnt get a chance to say anymore as I asked him how much ploughing he had done ,,non .
He was just the same once we got lifting spuds ,,have I alltered this ,should I be doing something else ,dad says can you push on abit harder .
I gave him the manual for the harvester and told him to go read it ,I knew that machine inside out and could tell where every squeak was coming from .
I loved the job ,variety every day but it was one push too much .

I think the rules say you cannot give a bad reference. You end up saying things like, "you will never know just how lucky you are to get this guy to work for you" you are not allowed to add "he never bloody well worked for me". Word gets around all the same.
I think you can state anything thats true which could amount to a bad reference , if you lie you are in trouble , opinions are best avoided ,just quote facts .

I`d be careful , pay him everything he`s owed and move on or you`ll end up at a tribunal answering constructive dismissal claims , if you`ve ever done anything illegal/ against H&S laws , parked on a double yellow line etc etc expect it all to come out and maybe even make your local newspaper.

It works the other way too, the employee was in breach of contract, (you don't know what was in the contract) so if both sides want to they can push the issue. Any misconduct, timekeeping issues or discipline matters from the employee will come out too.

Like what? make them come back and work their notice ? those day are long gone :ROFLMAO:

You have to pay them for the days they`ve done as well as all holiday pay and pension , you dont have to give them a reference though.
You dont have to pay their long service leave entitlements here if they leave of their own accord. Only if you sack them. But even then , willful or malicious conduct as a reason to fire them means they've not entitled to it either.

In the UK I don't think you can withhold pay
You cannot here unless it specifies it in the agreement, same thing if you want to make deductions from pay for other things (eg the driver's licence I mentioned in my example).

Technically it's theft unless it's specifically in there (and signed before the employee begins work) within NZ employment laws

It'll be different if it's a contractor or someone self-employed, I would assume.

Legal or not, we have started docking our useless workers pay when he fails to show up without notice (generally it's just simply not getting out of bed). He is on a fixed wage , not an hourly rate. So , not as simple as only paying for hours worked. Got to the point in August when he failed to show or was severely late 8 out of 21 days.

Not worth getting into as an employer, just pay what they are owed and forget them.

Not just true but provably so in a court of law, as I understand it. The employer could, for example, post a half page ad in The Farmer's Guardian stating the facts, but it is defamation if he can't prove it in court. And there might be consequences if he did even if it was true!
