I would agree “at present “from my perspective the legal system when it’s required to produce “justice” cannot be relied upon to be fit for purpose.
Solicitors rely on getting away with “playing dirty” which is somewhat shocking eye opener to honest normal folk. Yes the establishment seems to condone their practices even their malpractices. Not least Natural England.

The entire system is seemingly there just to allow the legal profession to make as much money as possible, I often wonder about some of the high profile long drawn out cases, those ones where a person wins in court, the defendant appeals and wins the appeal, the other side appeal and in turn win at the high court and of course the 2nd time loser then appeals again. Are the courts deliberately dragging things out to increase the earnings of their "learned friends" ?

I see NE are currently looking for 55 new “catchment sensitive advisers” via TFF jobs board. £26k each.
A welcome recruitment drive but their misguided Devon legal case “too date”could have covered 13 advisers new recruitment annual salary spend.
Natural England knows best with taxpayer cost benefit analysis??

If in doubt, add clipboards. Oh, and keep folk buying houses.

You’d think wouldn’t you, that we are living in some kind of era of pollution crisis? Well the water in the watercourses looks pretty clean to me and we’ve doing all the right things for about 30years. I can only recall one watercourse pollution incident during these last thirty years within a 10 mile radius of here and it was pretty minor. So isn’t this just another fabricated crisis designed to create even more non jobs and suck yet more money into a non productive bottomless pit? No doubt they’ll be round soon prying and poking and will need to find something wrong to justify their existence and impose some new and costly burden on worn out business folk.

Well the legal system is certainly broken. I will give you a simple accounting challenge based on real facts from a dishonest solicitor. All you have to do is guess whether the solicitor is owed any money and if so how much.

Period 1 Invoice 2325 cleared bank payment 2325

Period 2 Invoice 7231 cleared bank payments 7400

Period 3 Invoice 4219.30 credit note 4275
Bit disappointed with the number of guesses but the answer provided by the court was the solicitor was owed 9503.56 with an additional 10000 for costs. Now have a guess how much I have had to pay solicitors and barristers to get to this result. Certainly the justice system in the UK appears to be broken especially as more solicitors are appointed as Judges. Not suggesting any conflict of interest but cannot see any other reason.
Would make an excellent TV documentry if anyone interested.

That is a shockingly badly written letter!! I would do an impact assessment on his grammar!!
I really hope all works out well for you. The way Natural England conduct themselves is criminal!!!

Natural England have made all government schemes significantly less attractive for many with this one.

I would say this situation (not to mention this letter) has made @Janet Hughes Defra ’s life more difficult, but that would be a drop in the ocean compared to the difficulty @ajcc is facing as a result of all of this. Someone I really feel for.

Government bodies seem to tie farmers up in knots…..and are very quick to jump down farmers throats through the legal system when they feel like it too. Awful behaviour in my opinion.

I totally agree, unfortunately we are ruled by a myriad of "air raid warden Hodges" who all seem to work for the government

@AM_Arable may be helpful at highlighting this heavy handed behaviour.

I would dread ever receiving anything like the letter you have received here. That alone would put me right off dealing with government bodies in future.

Thinking about it I don't think I would be at home that day but would have an appointed agent to represent you so they cannot accuse you of any inappropriate behaviour. From my experience it will be difficult to remain impartial and you may well say or do something you may regret at a later stage. Don't stoop to their low level and don't let them poke the bear.Always try and keep the upper hand . We all know what a bunch of ba**trds they are!

Apologies if it is in the thread somewhere but might I ask what historic Natural Engalnd option was on the parcel/s in question and what have you done at that parcel with which they have found fault?

"Under regulation 30, Natural England has the power to authorise a person to enter land at any reasonable time to ascertain whether an offence has taken place in relation to the offences 22 to 24, 26 or 28. If you are not willing to allow us on the land voluntarily then we will look to secure these powers of entry to undertake the visit.

As per regulation 30, any authorised person may enter the land and take with them any necessary equipment or persons. Once on the property they can take soil samples, plant specimens or samples taken from plant specimens to ascertain whether an offence has been committed."


Essentially, under Reg 30, we can do the f*ck what we like... Make the EA look almost acceptable.
