Neighbour Wanting Access.

Aye-up,

I have a neighbour, alright but it’s a bit prickly with his wife on account she thinks it’s alright to blatantly cut my hedge whenever she feels like it. They bought a big property up the private lane past our land


He wants to put in a new water pipe and BT cable ducting (I presume to get better internet) with a trenching machine. He’s stated he will make good any damage to the field.

It’s permanent grass, distance of about 200m

Anything to ring alarm bells?

You will need an easement for when there is a leak or repair to make. It will state his rights of access to repair and compensate for damage in legal terms. I presume he doesn’t currently have water from across your field, and if not, why can’t he renew existing pipe under his current easement? It would be an ideal time to bring his attention to the meddling with your property.

Regarding the phone/broadband duct, I would have thought the phone company would contact you.
We have just agreed to a BB duct along one of our fields for a neighbour, and all the dealings were done between us and Openreach to agree satisfactory compensation for the work and crop damage.
You don’t want to let it happen for nothing, when do you ever get anything like that for free? They do expect to pay, and will more than likely built this into your neighbors quote, as that’s what happened here.
And they are also aware I’ll be seeing if any drains have been damaged before the trench is backfilled.
It could be well worth using an agent too if you don’t see eye to eye with the neighbour, as also if he moves on in future you need to be certain of things regarding access as stated above in the event of a fault/burst.

If she trims your hedge, I would insist on the right of access to her hedge in return!

But seriously, why do they now want to put water etc. across your property? Does their property not have frontage to a public road?

The chap probably doesn’t realise how it works and thinks it’s straight forward and free on someone else’s ground, or hoping to drop a pipe in on top of the duct before backfill, my guess is he hasn’t even spoken with the phone company yet, probably just discussed it over a pint in the local with a plant contractor as a quick fast buck job, maybe it was @Kevtherev!?

Its not what damage is done when he installs the pipe and duct, its the damage done when repairing etc. Plus he probably wants to go up the field to save money over going up the road/roadside, plus could he be going to develop his property into seperate dwellings , there is a fair chance of an element of betterment maybe?
As an aside could your wayleave payment be unlimited water for any purpose you choose from his pipe at zero cost to you/future owners of the land in perpetuity? Might be handy/save money/save chasing money??
If you go with it use an experienced agent/lawyer of your choosing at his cost.

Edit. Also if you or yours damages said pipe/duct/cable repair is not your responsibility or at your cost.

How much will you be increasing the value of his property by? You can be sure you won't be increasing the value of your land. Even if you get along now that might not be the case in the future.
He probably won't want to pay much for it. Have you ever wanted to run any pipes under his land ? If you have it would be interesting to know his reaction if you asked him.

If someone else has access to your land then it is devalued. You should explain this is not a personal thing but to protect future occupants. If you sell and there are utilities with no agreement then may have to be done in retrospect. Same if someone buys his - you could deny them access to repair without a huge fee.
Speak to a lawyer who will list the usual conditions and he should pay something for digging your field.

Tell him to feck off, in my experience just not worth the hassle, if you do so, it's at your own peril,it will only come back to bite you in the arse at a future date.?

Once he has his water connection, I do not think you can legally legally cut him off if you fall out in future.
I assume perhaps neighbour has asked for a price from utilities which made him blench, and he has been told it will be way cheaper if he digs in the duct/pipe, and utilities only have to make the connections either end?
If you can take or leave the bloke, and he has nothing you need, I'd refer him to your agent.
