New drainage or improvement

rent a bit of aha , drainage in one area is knackered and after inspecting it looks like 2 inch clay tiles , no shingle put in by hand no doubt many years ago.

Had landlords agent out all good , two schemes submitted as asked for.

Their argument to start was repair or replacement , repair is 50/50 contribution where as replacement is landlords but easy to say it is a replacement only.

Now they have come back , after agent has spoken around his office , to say its an improvement as single will be used , told him as it's not my land and is rented I don't care if they just put the pipe in without single to which he muttered well to do it properly etc.

It's a field which does not lend itself to spring cropping if it's not ripped up early but again the area in question will not produce much anymore.

Is there a quoted section of aha law etc I can put in front of him , likewise if I cannot earn off this area can I claim against the landlord , don't want to but it might get the ball rolling.

I have a little knowledge about aha and drainage but a little knowledge can be dangerous , I know I am right but just need the right imformation to put under their noses.

Since no-one is going to be able to replace 2 inch clay tiles, tell them to use modern equivalent and that as a gesture you will pay for the shingle? (ie the improvement)

I know very little about AHA but in my experience you are very lucky to be offered 50%.
And of course if you play it right your 50% contribution may well be less then their 50% .

All done , stuck to my guns and they have offered to pay for everything.

Think this just proves the point that even a silly old farmer , if knowing the tenancy and how it's written , can deal direct with agents acting for the landlord.

Best money we spent a couple of years back having AHA tenancies looked through and a list of liabilities and who is responsible.
