Sadly, it is all too easy for the captain to maintain that the OP threatened to shoot him if he interferes.

Plod will not ask for proof (and doesn't need it), they'll just lift the OP's guns anyway. May be an idea to park them with the local firearms dealer until the dust settles.

I'd get my solicitor to write a letter stating that the OP intends trimming the trees and asking if the captain has any requirements for disposal of the trimmings which he has a right to. Require (politely) a reply within, say, 10 days. No communication should be made directly, only through a solicitor.

Don't forget the golden rules when dealing with Plod :

1) get your complaint in first - when he told you not to cut them, did he do it in a threatening way?
2) remember the magic words - did he call you a homo? Did he infer any prejudice towards you that could be construed as sexism, racism, religionism etc that might make his above verbal assault a hate crime?
3) in light of the above, do you need police protection to avoid what you fear may become a breach of the peace in their stoping your lawful action on your own land? Do you fear from his "military past" that he may be armed? Have you been threatened by someone with access to a firearm?

He sounds like a f**king pansy so go in hard and deep. Strike first. Strike so hard they can't strike back. Then keep striking until they stop moving. Then strike one more time, just for luck.

There is no obligation for a landowner to trim branches that overhang another’s property but the person on whoms land they overhang is entirely within their right to remove them so long as other have said that they are offered back to the landowner.
You have been more than reasonable @dubs in contacted the neighbour about it. If he chooses to bury his head in the sand about it that’s his problem. If he decides to get arsey about it the law is on your side regardless of whether damage has already been caused or not.
The law should Be changed, trees should not be allowed to be planted on boundaries.
The owner of the trees should be responsible for trimming them, not passing lorries or the council

Never mind the real police, just mention on the 'Wreckers' thread that you saw him pulling out of a blind exit in a farm vehicle, and the TFF 'police' will be round to beat him to death with lengths of alcothene pipe. Poor bugger.

Speaking as somebody with terrible neighbour relations I would try to make sure that you look like you’re acting reasonably.

I don’t think it looks very good to knock on an elderly mans door on Tuesday and send in the chainsaws on Wednesday morning regardless of your legal rights and “Major Disaster” being a PITA.

You need to give it a bit of time. Write to him explaining why you need to do it and gently explain that you have a legal right but you are happy to carry the cost of the work and would like his input to make sure all parties are happy with the work. You intend to start the work on xxxxx (about a month) then crack on with it.

So whats the law if on a narrow lane the owner of a hedge with trees in it, it is over growing into the lane, it,s hard to drive buy without hitting your mirrors, broke one the other day, I would happily go a cut it back for free just to improve access. Whats wrong with people that clearly are being awkward and want to be a total pain in the ass, basically, any vehicle larger than a car has a problem getting through.
