Planning Applications, PD and the like (General Chat)

@George from SJM Planning how much weight is given to Neighbourhood Development Plans during a planning application? Our NDP was voted through a free weeks ago, so as I understand it it has become a legal entity.
So if it has been adopted by the Local Authority it now becomes a formal consideration when assessing planning applications. It is effectively the third tier of planning policy behind the NPPF and GPDO as the overarching documents, the Local Authority Development Plan comes below that and then the Neighborhood Plans.

I would like to build a new indoor silage pit, I have been looking at permitted development, and i just want to check a couple of things.

The proposed site is not adjoining my current steading, it’s about 120 feet away over the road. I understand I’m limited to 10,000 feet every 2 years, so 50'by 200’ what is the height limit.

There are houses nearby but I think far enough away, how close can you build a silage pit from a protected building under pd?
The road is also quite near, again how close to the road can you build under pd?

Any help much appreciated.

Is the land over the road greater than 1Ha in area? If not then it would need full planning permission. Also, is this piece of land part of the main farm in terms of ownership and operation? I assume the main holding is larger than 5Ha.

You are limited to 1000sqm (10763.9sqft) every two years so yes 50 x 200 is ok providing you can justify the need for a pit that size. Maximum height is 12m if you are over 3km from an aerodrome, 3m if you are within 3km.

Personally I have not made an application for a silage pit but I would imagine the LPA would not see it as necessary if the crop filling it is not grown on the land OR that the crop stored in it is not used wholey on the farm. I think they would be way of allowing such a size if for example the crop filling it was purchased off of another farm and the silage was later sold on. If the crop was grown on the farm and then the excess was sold on then I think it would be ok; equally if the farm required more silage than it could produce and the extra was to be stored in the pit then also I think that would be ok.

A set distance from protected buildings is only required for animal housing and slurry/sludge storage.

Permitted development is not permitted within 25m of a metalled road.

A GENERAL NOTE TO ALL - NEVER MENTION CONTRACTING IN ANY FORM WHEN APPLYING FOR PERMITTED DEVELOPMENT - Whether it be for the storage or maintainance of machinery used for contracting or the storage of crops/animlas for others it will automatically red flag an application. The requirement is that it is needed for that holding.

You can use this allowance every 2 years, is it 2 years from when the plans were approved or 2 years from completion of building?

It doesn't need to be adjacent to the holding as long as it can be proved that the land is part of the holding and the land it sits on is greater than 1Ha.

The application will still go online and NIMBY's will still try to influence the decision but they will not be consulted, neither will the parish council, highways etc. They may all still contact the LPA but providing your application clompies with all aspects of Part 6 of the GPDO then they have no wiggle room.

I believe the 2 years starts from the completion of the build, the actual phrase states "provided within the preceding 2 years". It is also interesting to not that this only applies within 90m of the previous works. So if you wanted to put up another building 100m away then you don't need to wait the 2 years

You can build it right up against a protected building as far as the guidance states. There is no minimum distance.
 
Just one thought. As there will have to be effluent storage to meet ssafo regs, is this now 'slurry' storage, with the planning restrictions that follow?
Now that is something I have no knowlege about. If you are required to store some sort of effleuent then I suppose the storage element will need to be more than 400m from the protected building. Could it be something that is collected and transported regularly enough that it could be argued that is isn't being stored there?

I don't know for sure either. Never tested it as the 465 sqm limit was in play when last did one, so full planning was needed anyway.
