I would persoanlly assume that the 'right of way' would be sold with the property
Assumption is the mother of all f**k ups.
Read your deeds, the sentence will be under access and you are hoping for the sentence that says "access with and without vehicles for any purposes". What you don't want is "access limited to agricultural use".
Assuming anything without actually checking is quite a big mistake.

Question ref. class Q and new barn PN rights if anyone knows. Ag holding, 1 barn not really suitable for Ag. What I would like to do is put in for PN on a barn first and then go for class Q on the old barn later. I gather that PN for barns can only be applied for every 3 years. Class Q means no PN for 10 years. Correct me if I'm wrong.

What I would like to know is, can I put in for a decent barn now for hay / straw / machinery and then in 3 years put in for class Q on the old barn? Or would I have to wait the 10 years after the new barn?

I may have the wrong end of the stick anyway.

You would be better putting in Class Q now and clearly state in the application that the barn is no longer fit for agricultural use and then once approved apply for full planning for a new barn.

I was under the impression that a full PA would require far more detail and justification? ie. you'll probably get more barn under PN?

To be honest with how most council's assess PN you will be doing the same work.
I have one on Bolton which I have had to do far more work on that I did for the last full planning agri barn.

No it does not. Class Q is only affected by 'development under Class A(a) or Class B(a) of Part 6'.
A(a) and B(a) are both relating to the extension or alteration or a building (errection also in the case of A(a)).

It is a shame as Wales probably needs it more than England on the grand scale of things.
My long term plan is to eventually make use of class Q but there is always the threat of it being removed, the other good news in there is that they are proposing to make where I live AONB so scuppering class Q anyway. Very pleased to hear they are keeping class Q and allowing it in AONB too.
We'll see.

There is a reason I don't actively seek planning work on Wales.
I also know that our local authority are down to their last planning officer so I asked if they needed someone on a short term contract to assist until they covered their positions (with approval from my boss). Despite actively working in the industry for nearly a decade I would not pass the soft because I do not have a degree - not a planning based degree, but any degree. My wife who has an archaeology degree has a better chance at getting a job in our local planning department than me!
