It looks like coldlap where the welder has welded down the corners.Maybe if the manufacturer stands by their product and I receive good service.

How many more welds are like that, you will be able to tell and they should all be regarded as suspect.
If the manufacturer farmed out the work the subcontractor may have used thinner box on the headstock as it looks very thin. Could some of the previous problems been down to faulty welding. Is it a machine that could be re-framed.
Push for a new frame. They must have known about the coldlap when they repaired it before so why didn't they re-weld it.Yes,it could be re framed relatively easily.
Previous problems were due to poor/lack of weld.

They shouldn't. The last iron mine in the UK closed a VERY long time ago.Think the guys in Scunthorpe might disagree with that.
