Rain guns on slurry tankers

Talking to the milk tanker driver the other night. He said a big producer of milk got stopped by the environment agency. From spreading slurry off a public road onto fields with the rain gun. Stating it was against the law. Think they only investigated because somebody local reported him. Is this true?

Round here the offence is likely to be "spreading on waterlogged ground " or too close to a ditch but SEPA is being pragmatic and will give you permission/a derogation to spread with a rain gun on sensible areas if you ask. If you do not ask and do it anyway you are breaking the law.

Logically, if it is not legal then why do tanker manufacturers offer a rain gun as an option?

BTW, i did note that a recent item on Wales Today about agricultural pollution in rivers used an image of a tanker gunning over a hedge to illustrate the point. Didnt look too clever in truth

Same as 50/60 kmh tractors , don't have to use it

I think spreading dirty water would be legal. However, a lot of peoples definition of dirty water is different to the EA's...

Spreading slurry via a rain gun is considered a non compliance.
Spreading slurry via a rain gun off a road is considered a major non compliance.

The fine ranges from 20-300%.
Mitigation is possible down to 15%.
Derogation is possible on a case-by-case basis.
 
On a related note, my neighbour is currently spreading slurry straight thro the night, going thro a quiet village on a week night with a 50kph noisy tractor and 2600 gallon slurry tanker, drives straight past my farm which is around 300-500 yards off the road, and he is keeping me awake at night so dare to think what’s happening in the village, what rules and regulation are there against him doing this?? He’s barely done much slurry spreading during the day and seems to come a live at night and don’t think it’s right in him keeping what could be school children awake all night hauling slurry when they will have school the following morning, I’m not complaining but bet others living in the village will be.

A silage crew got stopped by the police from carting through our local town at night. They were actually doing it to stop there being as much congestion during the day but the police had received a number of complaints so had to act. If no-one complains then he'll be fine. He would have a hard job keeping me awake a night unless he was driving through the bedroom!:sleep:

Only talking about this earlier as we have a lot of steep ground that the cows are robbing P&K from the steep and dumping it in their dung on the only level bit in the field. What kind of solids can a rain gun handle, is there a particular brand that is concidored the best?

Way back in the 70's used to do this in the days before we had enough storage. Was a little shocked a couple of years ago when I went to a talk about pollution prevention in catchment areas, and the speaker put up a picture of our tanker blowing over a ditch, 40 years ago. Head down time!
Years ago an arable neighbour upstream of us on a small stream had a real go at us because he said we were not dredging the stream out and it was backing up under a culvert and flooding his wheat. We tried over several months to point out that the sediment was all coming off his land which to be frank should really have been in grass not arable but he would have none of it. So when I was then appointed to work on a local catchment sensitive farming project, I took great delight in using some of the pictures of his run-off (taken from the road) at farmer meetings, They were a great illustration of typical sources of the sediment that was causing issues in the local river (sediment and phosphate being the problem). I didn't name him but he was in the audience and he did find his shoes rather interesting for the next 20 mins or so.
