In Scotland rough land used to be thrown into a lease for nothing. Then, when the land came to be sold, the "for nothing" land was often forgotten about by the lawyers.

I know of one such case where the purchaser got 125 acres extra that was not included in the sale particulars! I even got a few extra acres here. My solicitor said it wasn't in the deeds so didn't exist. I went to the Law Society and they said he was duty bound to include it but also for him to insure (at his expense) against the possibility of a boundary dispute in the future.

If my solictor lost some of my acres, I'd be suing him. That's what professional indemnity insurance is for and why we employ a professional.

It all depends on whether the payment is intended to be income support, or to encourage food production, or maximise environmental benefit. If it is the first then it ought to be capped, if it is the others it shouldn't. Income support is, of course, already available to everyone so I'm not sure why we should expect an extra divy just because we farm.

Any less than 50 acres and you should not be eligible to claim BPS to begin with. Lets get real.
I believe that the average EU farm size is about 17ha so I can't see there being much backing for an increase in the minimum size. The people calling for maximum size capping should also bear this in mind, not many UK farms would be happy if the cap was set at the EU average!

One thing that every poster on the Forum agrees with is that if there is a cap it should be just above what they themselves are farming, unless of course they get that bit of ground next door in which case the cap should be set a bit higher.

Bloody farmers, don't you love them.
