Red Diesel?

We are having a piece of land levelled and compacted for a yard in April, can the contractor use Red diesel?

Actually I think he can as long as the tank is drained of red and flushed then refilled with white when heading to a non agricultural job ,

My understanding is that as the contractor is being contracted for a non agricultural purpose, even though the customer is an agricultural business, then red diesel should not be used after 1st April.
This is how I read the law, yet we need a piece of land levelled to put up a barn, and turning area, surely thats agricultural?
I think I may have opened up a can of worms here!

We have this with a small contractor who brings a tractor and trailer in silaging. I always arrange to hire his tractor and pay him to drive it, I presume you could do the same with the digger.
