Research and development tax relief

I know someone who claims regularly. However, I think he’s skating in extremely thin ice as the “research” he’s doing isn’t new or groundbreaking, it’s just tweaking things (and often has been done elsewhere already).

I have a feeling that a large % of R&D tax rebate claims would struggle to stand up to any detailed scrutiny. And particularly in the farming sector, there is very little an individual business could be doing that would not be covered by pre-existing institutional research somewhere. The guidance is very clear, the work has to be new and ground breaking for the industry as a whole, not just the individual business. Yet there have been salesmen on here suggesting that R&D credits could be obtained for merely incorporating well known technology in ones business for the first time.

Given the need for more tax revenue will be paramount in the coming years after all the money spend on covid matters, I can see HMRC deciding to go over R&D claims with a toothcomb in future, including already paid out claims. It will be an easy win I suspect to generate significant tax revenue from identifying iffy (and outright fraudulent) claims.

The ones I have heard of would not stand any scrutiny, and in many cases could be seen as pure fraud I suspect. one example I heard was "We used a different milk powder and put all the milk powder and calf rearer costs in as R&D" - calves not even weighed! Another used a grain treatment that I'm sure was around 20+ years ago and claimed it was R&D..... Personally, I'd rather sleep at night.
