We had a phone call do we want any road planning's we agreed to to buy 386 tons and paid half upfront on the same day. The started delivering the planning's the next day and the next days no account was made of how many loads were delivered.
I have paid the outstanding agreed amount with VAT.
Now there saying they delivered more than what was agreed and want me to pay more were do i stand as there are no load tickets or how many loads that were delivered.
It was tip on to an exciting heap that was there.

Tell them you are very disappointed in their mistake, of course they are entitled to collect the excess, they must however only take what is due to them, which will involve very careful analysis of the heap to see where they began to tip and 100% weighing of what they delivered. Also there will be a storage charge for their use of your yard storing their planings without your permission, I would be very fair with the storage charge and pitch it somewhere between 50 and 75% of the value of the planings!!
 
Quality Protocol for inert wastes dictates that delivery documentation must be produced.. so they must have some sort of records that they can share with you.. or if you must have a waste exemption they must produce Waste transfer notes.

Ring your local EA office and I'm sure they will be able to help you out on a tonnage estimation at your site :ROFLMAO:

Where do you stand…?! Holding most of the cards by the look of it.

I hope that they have delivered at least the required quantity.

Next time I’d try and keep a record of how many come in, and take tickets from drivers at the time. 386t I assume is 20 x 20t tippers. I appreciate it’s not easy to do so when you are busy, but it can save a lot of hassle like this.

Tell them you counted 20 loads. Should have a waste certificate so if there is none available then it may be they were supposed to dump it somewhere else and are trying to get paid twice. VAT suggests they are OK assuming you actually got an invoice?

i had 10 loads a while ago , had 6 tickets ,they billed me for 6 loads ,i paid up and shut up

You agreed to buy 386 tonnes, you pay for that and that only. If they made a mistake and accidently delivered more that's down to them. If you have paid them for 386 tonnes then your part of the contract has been fulfilled.

Can't understand how you think its ok just to pay for six loads when you had ten delivered . I am assuming that you ordered or agreed to buy ten loads . In my maybe old fashioned or out of touch little mind that's pretty much the same as stealing the value of four loads, it wouldn't sit well on my shoulders .
