S 106 s

Having a real battle with planning to extend a shed. It is extending into a grass field that has been in grass for more than 5 yrs but isn't classed as any interest by Natural England as its sprayed fertilized and cut every year. Planning or Ecology want to impose a S106 on me to compensate for the loss of habitat to the degree of 0.14 what ever that is as it dosn't equal a measurement to the size of extension. Has anyone else experienced this.
Particularly annoying as same field last year freestanding barn got planning no problems and no conditions on it.

Have you considered offset with some other small areA of land on the farm to create a habitat of greater value than the one lost, you may have to remove this from your single farm payment

Can you find out how much money the 106 is going to cost? You may be able to do an ecology survey to argue there will be no effect on local wildlife but if the 106 isn’t much money you might as well just pay it

Is this being done on PD or full PP? Have they provided a statement to justify their position on requiring the s106?

Thats what i will end up doing i guess. I have had such a battle with this planner to even just to start to look at the application. its now 6 months since submitting and 8 weeks since we should have had a decisions on an 8 week process. Getting very frustrated and more stubborn as a result!!!!!

I would be inclined to argue that as it's not permanent grassland that it wouldn't apply - it's down to the planning department to justify their decision to say that it does & provide relevant policies to back up their position.
